Pursuant to a notice posted in accordance with Senate Rule
11.11, a public hearing of the Senate Committee on Economic
Development was held on Tuesday, May 4, 1999 in the Lt.
Governor's Committee Room, at Austin, Texas.

The Chairman called the meeting to order at 9:05 am. There
being a quorum present, the following business was transacted.
The Chairman advised that SB 1873 had been tagged pursuant to
Senate Rule 11.19 and would not be heard.
The Chairman laid out HB 749 and recognized the Senate
sponsor, Senator Nelson. Senator Jackson sent up a committee
substitute and Senator Nelson explained the difference between
the committee substitute and the bill as filed. Witnesses
testifying and registering on the bill are shown on the
attached list. Chairman Sibley moved that the public hearing
be closed; and that HB 749 be left pending for a quorum;
without objection, it was so ordered. Upon arrival of a
quorum, Senator Madla moved adoption of the committee
substitute, without objection, it was so ordered. Senator
Madla then moved that HB 749 do not pass but that CSHB 749 be
reported back to the Senate with the recommendation that it do
pass and be printed. The motion carried with a vote of 6
ayes, 0 nays, 0 present not voting, and 1 absent.
The Chairman laid out HB 341 and recognized the Senate
sponsor, Senator Nelson, to explain the bill. Chairman Sibley
then called for public testimony on HB 341 to commence.
At 9:50 am the Chairman advised that public testimony would
continue after the Committee reconvened
and moved that the Committee stand recessed until after
adjournment; without objection, it was so ordered.
At 12:46 pm the Committee reconvened and consideration of HB
341 continued. Senator Sibley sent up Committee Amendment 1
and moved adoption; without objection, the amendment was
adopted. Testimony continued on HB 341. Witnesses testifying
and registering on the bill are shown on the attached list.
The Chairman then moved that the public hearing be closed, and
that HB 341 be left pending to await a quorum; without
objection it was so ordered. Upon arrival of a quorum,
Senator Sibley requested unanimous consent to incorporate the
amendment into a committee substitute; without objection, it
was so ordered. Senator Sibley then moved that the new
committee substitute be adopted; without objection, it was so
ordered. Senator Jackson moved that HB 341 do not pass but
that CSHB 341 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a vote of 6 ayes, 0 nays, 0 present not voting,
and 1 absent.
The Chairman laid out HB 744 and recognized the Senate
sponsor, Senator Bernsen, to explain the bill. Witnesses
testifying and registering on the bill are shown on the
attached list. Chairman Sibley moved that the public hearing
be closed; without objection, it was so ordered. Senator
Sibley moved that HB 744 be reported favorably to the Senate
with the recommendation that it do pass and be printed. The
motion carried with a vote of 6 ayes, 0 nays, 0 present not
voting, and 1 absent.
The Chairman laid out HB 1642 and recognized the Senate
sponsor, Senator Nelson. Senator Carona sent up a committee
substitute and Senator Nelson explained the difference between
the committee substitute and the bill as filed. Senator Madla
moved adoption of the committee substitute, without objection,
it was so ordered. Witnesses testifying and registering on
the bill are shown on the attached list. The Chairman then
moved that the public hearing be closed and that HB 1642 be
left pending; without objection, it was so ordered.
At 1:40 pm Senator Carona assumed the Chair, laid out HB 2061
and recognized the Senate sponsor, Senator Sibley. Senator
Sibley sent up Committee Amendment 1 and moved adoption;
without objection, the amendment was adopted. Witnesses
registering on the bill are shown on the attached list.
Senator Sibley requested unanimous consent to incorporate the
amendment into a committee substitute; without objection, it
was so ordered. Senator Sibley then moved that the new
committee substitute be adopted; without objection, it was so
ordered. Senator Sibley moved that HB 2061 do not pass but
that CSHB 2061 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a vote of 5 ayes, 0 nays, 0 present not voting,
and 2 absent. Senator Sibley moved that the bill be
recommended for placement on the Local & Uncontested Calendar;
without objection, it was so ordered.
The Chairman laid out HB 2223 and recognized the Senate
sponsor, Senator Sibley, to explain the bill. Catherine
Ghiglieri, Commissioner of Banking, testified as a resource on
the bill and submitted written testimony. The Chairman then
moved that the public hearing be closed; without objection, it
was so ordered. Senator Whitmire moved that HB 2223 be
reported favorably to the Senate with the recommendation that
it do pass and be printed. The motion carried with a vote of
5 ayes, 0 nays, 0 present not voting, and 2 absent. Senator
Whitmire moved that the bill be recommended for placement on
the Local & Uncontested Calendar; without objection, it was so
ordered.
The Chairman laid out HB 2320 and recognized the Senate
sponsor, Senator Sibley, to explain the bill. Catherine

The Chairman laid out HB 3023 and recognized the Senate
sponsor, Senator Sibley, to explain the bill. Kevin Brady,
representing the Texas Department of Insurance, registered as
a resource witness on the bill. Senator Whitmire moved that
HB 3023 be reported favorably to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a vote of 5 ayes, 0 nays, 0 present not voting,
and 2 absent. Senator Whitmire moved that the bill be
recommended for placement on the Local & Uncontested Calendar;
without objection, it was so ordered.
At 1:50 pm Senator Sibley resumed the Chair, laid out HB 504
and recognized the Senate sponsor, Senator Carona. Senator
Carona sent up a committee substitute and explained the
difference between the committee substitute and the bill as
filed. Senator Carona moved adoption of the committee
substitute, without objection, it was so ordered. Witnesses
registering on the bill are shown on the attached list.
Senator Carona moved that HB 504 do not pass but that CSHB 504
be reported back to the Senate with the recommendation that it
do pass and be printed. The motion carried with a vote of 6
ayes, 0 nays, 0 present not voting, and 1 absent. Senator
Carona moved that the bill be recommended for placement on the
Local & Uncontested Calendar; without objection, it was so
ordered.

The subcommittee report on SB 1819 was laid out by Senator
Madla, who moved adoption; without objection, the subcommittee
report was adopted. Senator Madla moved that SB 1819 be
reported favorably to the Senate with the recommendation that
it do pass and be printed. The motion carried with a vote of
6 ayes, 0 nays, 0 present not voting, and 1 absent. Senator
Whitmire moved that the bill be recommended for placement on
the Local & Uncontested Calendar; without objection, it was so
ordered.
At 2:00 pm Senator Whitmire assumed the Chair and recognized
Senator Sibley to lay out the subcommittee report on SB 1617.
Committee Amendment 1 had been adopted in subcommittee.
Senator Sibley moved that SB 1617, as amended, be reported
back to the Senate with the recommendation that it do pass and
be printed. The motion carried with a vote of 6 ayes, 0 nays,
0 present not voting, and 1 absent. Senator Madla moved that
the bill be recommended for placement on the Local &
Uncontested Calendar; without objection, it was so ordered.
The Chairman laid out HB 1707 and recognized Senator Sibley,
in the absence of the Senate sponsor, to explain the bill.
Witnesses registering on the bill are shown on the attached
list. The Chairman moved that the public hearing be closed;
without objection, it was so ordered. Senator Sibley moved
that HB 1707 be reported favorably to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a vote of 6 ayes, 0 nays, 0 present not voting,
and 1 absent. Senator Sibley moved that the bill be
recommended for placement on the Local & Uncontested Calendar;

There being no further business, at 2:05 pm Senator Sibley
moved that the Committee stand recessed subject to the call of
the Chairman. Without objection, it was so ordered.
