         Pursuant to a notice posted in accordance with Senate Rule  
         11.11, a public hearing of the Senate Committee on Education  
         was held on Wednesday, April 7, 1999 in the Capitol Extension,  
         Room E1.012, at Austin, Texas.

         The Chair called the meeting to order at 9:15 am.  There being  
         a quorum present, the following business was transacted.   
          
         The Chair laid out SB 836 and recognized the author, Senator  
         Duncan, to explain the bill.  A committee substitute had been  
         previously adopted at the hearing on March 31, 1999.  Senator  
         Nelson sent up Committee Amendment 1 and moved adoption;  
         without objection, the amendment was adopted.  Senator Nelson  
         requested unanimous consent to incorporate amendments into the  
         committee substitute;  without objection, it was so ordered.   
         Senator Nelson then moved that the new committee substitute be  
         adopted; without objection, it was so ordered.  Witnesses  
         testifying and registering on the bill are shown on the  
         attached list.  The Chair moved that SB 836 be left pending to  
         await a quorum; without objection it was so ordered.  Upon  
         arrival of a quorum, Senator Nelson moved that SB 836 do not  
         pass but that CSSB 836 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a vote of 5 ayes, 0 nays, 0 present not voting,  
         and 4 absent.  Senator Cain moved that the bill be recommended  
         for placement on the Local & Uncontested Calendar; without  
         objection, it was so ordered.   
          
         Senator West moved that the minutes from the prior meeting be  
         approved;  there being no objection, the minutes were  
  
         approved. 
         The subcommittee report on SB 299 was laid out by Senator  
         West.  Senator West moved that SB 299 be left pending; without  
         objection, it was so ordered. 
          
         The subcommittee report on SB 751 was laid out by Senator  
         West.  Senator West moved that SB 751 be reported favorably to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 5 ayes, 0 nays, 0  
         present not voting, and 4 absent.  Senator Nelson moved that  
         the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         The subcommittee report on SB 947 was laid out by Senator  
         West.  Senator West moved that SB 947 do not pass but that  
         CSSB 947 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a vote of 5 ayes, 0 nays, 0 present not voting,  
         and 4 absent.  Senator Zaffirini moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         The subcommittee report on SB 989 was laid out by Senator  
         West.  Senator West moved that SB 989 be reported favorably to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 5 ayes, 0 nays, 0  
         present not voting, and 4 absent.  Senator West moved that the  
         bill be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.   
          
         The subcommittee report on SB 1289 was laid out by Senator  
         West.  Senator Zaffirini sent up a committee substitute; the  
         Chair recognized Senator Zaffirini to explain the difference  
         between the committee substitute and the bill as filed.   
         Senator Zaffirini moved adoption of the committee substitute,  
         without objection, it was so ordered.  Witnesses testifying  
         and registering on the bill are shown on the attached list.   
         Senator Zaffirini moved that SB 1289 do not pass but that CSSB  
         1289 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         vote of 5 ayes, 0 nays, 0 present not voting, and 4 absent.  
         Senator Zaffirini moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar; without  
         objection, it was so ordered.   
         The subcommittee report on SB 1290 was laid out by Senator  
         West.  Witnesses testifying and registering on the bill are  
         shown on the attached list.  Senator West moved that SB 1290  
         be reported favorably to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         vote of 5 ayes, 0 nays, 0 present not voting, and 4 absent.   
         Senator Zaffirini moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar; without  
         objection, it was so ordered.   
         The subcommittee report on SB 1326 was laid out by Senator  
         West.  Witnesses testifying and registering on the bill are  
  
         shown on the attached list.  Senator West moved that SB 1326  
         be reported favorably to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         vote of 5 ayes, 0 nays, 0 present not voting, and 4 absent.   
         Senator Zaffirini moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar; without  
         objection, it was so ordered.   
         The Chair recessed the hearing at 9:40 am until 30 minutes  
         after adjournment of the full Senate. 
          
         The Committee reconvened at 12:40 pm. 
          
         The Chair laid out SB 540 and recognized the author, Senator  
         Shapiro, to explain the bill.  Senator Cain sent up a  
         committee substitute; the Chair recognized Senator Shapiro to  
         explain the difference between the committee substitute and  
         the bill as filed.  Senator Cain moved adoption of the  
         committee substitute, without objection, it was so ordered.

         pending; without objection, it was so ordered. 
          
         The Chair laid out SB 541 and recognized the author, Senator

         Senator Bivins moved that SB 541 be left pending; without  
         objection, it was so ordered. 
          
         The Chair laid out SB 591 and recognized the author, Senator  
         Shapiro, to explain the bill. Senator West sent up a committee  
         substitute; the Chair recognized Senator Shapiro to explain  
         the difference between the committee substitute and the bill  
         as filed.  Senator West moved adoption of the committee  
         substitute, without objection, it was so ordered.  Witnesses

         attached list.  Senator Bivins moved that SB 591 be left  
         pending; without objection, it was so ordered.

         Nelson, to explain the bill.  Senator Nelson sent up a  
         committee substitute; the Chair recognized Senator Nelson to  
         explain the difference between the committee substitute and  
         the bill as filed.  Senator Nelson moved adoption of the  
         committee substitute, without objection, it was so ordered.

         At 1:50 pm Senator Zaffirini assumed the chair.   
          
         At 1:53 pm Senator Bivins resumed the chair.   
          
         The Chair laid out SJR 33 and recognized the author, Senator  
         Lucio, Jr., to explain the bill. Senator Zaffirini sent up a  
         committee substitute; the Chair recognized Senator Lucio, Jr.  
         to explain the difference between the committee substitute and  
         the bill as filed.  Senator Zaffirini moved adoption of the  
         committee substitute, without objection, it was so ordered.   
         Senator Cain sent up Committee Amendment 1 and moved adoption;  
         without objection, the amendment was adopted.  Senator Cain  
         requested unanimous consent to incorporate amendments into the  
         committee substitute;  without objection, it was so ordered.   
         Senator Cain then moved that the new committee substitute be  
         adopted; without objection, it was so ordered.  Senator Bivins  
         moved that SJR 33 be left pending; without objection, it was  
         so ordered. 
          
         The Chair laid out SB 1286 and recognized the author, Senator  
         Lucio, Jr., to explain the bill.  Witnesses testifying and

         At 2:40 pm Senator Zaffirini assumed the chair.

         Bivins, to explain the bill.  Senator Bivins sent up a  
         committee substitute; the Chair recognized Senator Bivins to  
         explain the difference between the committee substitute and  
         the bill as filed.  Senator Bivins moved adoption of the  
         committee substitute, without objection, it was so ordered.   
         Senator Cain sent up Committee Amendment 1 to the bill as  
         filed and moved adoption; without objection, the amendment was  
         adopted.  Witnesses testifying and registering on the bill are  
         shown on the attached list.  Senator Zaffirini moved that SB 4  
         be left pending; without objection, it was so ordered. 
         At 3:35 pm Senator Bivins resumed the chair.   
          
         The Chair laid out SB 1448 and recognized Senator Zaffirini,  
         in the absence of the author, to explain the bill.  Witnesses  
         testifying and registering on the bill are shown on the  
         attached list.  Senator Bivins moved that SB 1448 be left  
         pending; without objection, it was so ordered. 
          
         The Chair laid out SB 1450 and recognized Senator Zaffirini,  
         in the absence of the author, to explain the bill.  Senator  
         Zaffirini sent up Committee Amendment 1 and moved adoption;  
         without objection, the amendment was adopted.  Witnesses

         attached list.  Senator Bivins moved that SB 1450 be left  
         pending; without objection, it was so ordered. 
          
         The Chair laid out SB 1452 and recognized Senator Zaffirini,  
         in the absence of the author, to explain the bill.  Witnesses

         attached list.  Senator Bivins moved that SB 1452 be left  
         pending; without objection, it was so ordered. 
          
         There being no further business, at 7:10 pm Senator Bivins  
         moved that the Committee stand recessed subject to the call of  
         the Chair.  Without objection, it was so ordered.
