Pursuant to a notice posted in accordance with Senate Rule
11.11, a public hearing of the Senate Committee on Education
was held on Wednesday, April 7, 1999 in the Capitol Extension,
Room E1.012, at Austin, Texas.

The Chair called the meeting to order at 9:15 am. There being
a quorum present, the following business was transacted.
The Chair laid out SB 836 and recognized the author, Senator
Duncan, to explain the bill. A committee substitute had been
previously adopted at the hearing on March 31, 1999. Senator
Nelson sent up Committee Amendment 1 and moved adoption;
without objection, the amendment was adopted. Senator Nelson
requested unanimous consent to incorporate amendments into the
committee substitute; without objection, it was so ordered.
Senator Nelson then moved that the new committee substitute be
adopted; without objection, it was so ordered. Witnesses
testifying and registering on the bill are shown on the
attached list. The Chair moved that SB 836 be left pending to
await a quorum; without objection it was so ordered. Upon
arrival of a quorum, Senator Nelson moved that SB 836 do not
pass but that CSSB 836 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a vote of 5 ayes, 0 nays, 0 present not voting,
and 4 absent. Senator Cain moved that the bill be recommended
for placement on the Local & Uncontested Calendar; without
objection, it was so ordered.
Senator West moved that the minutes from the prior meeting be
approved; there being no objection, the minutes were
approved.
The subcommittee report on SB 299 was laid out by Senator
West. Senator West moved that SB 299 be left pending; without
objection, it was so ordered.
The subcommittee report on SB 751 was laid out by Senator
West. Senator West moved that SB 751 be reported favorably to
the Senate with the recommendation that it do pass and be
printed. The motion carried with a vote of 5 ayes, 0 nays, 0
present not voting, and 4 absent. Senator Nelson moved that
the bill be recommended for placement on the Local &
Uncontested Calendar; without objection, it was so ordered.
The subcommittee report on SB 947 was laid out by Senator
West. Senator West moved that SB 947 do not pass but that
CSSB 947 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a vote of 5 ayes, 0 nays, 0 present not voting,
and 4 absent. Senator Zaffirini moved that the bill be
recommended for placement on the Local & Uncontested Calendar;
without objection, it was so ordered.

West. Senator West moved that SB 989 be reported favorably to
the Senate with the recommendation that it do pass and be

West. Senator Zaffirini sent up a committee substitute; the
Chair recognized Senator Zaffirini to explain the difference
between the committee substitute and the bill as filed.
Senator Zaffirini moved adoption of the committee substitute,
without objection, it was so ordered. Witnesses testifying

Senator Zaffirini moved that SB 1289 do not pass but that CSSB
1289 be reported back to the Senate with the recommendation
that it do pass and be printed. The motion carried with a

without objection, the amendment was adopted. Senator Cain
requested unanimous consent to incorporate amendments into the
