Pursuant to a notice posted in accordance with Senate Rule
11.11, a public hearing of the Senate Committee on Education
was held on Wednesday, April 28, 1999 in the Capitol
Extension, Room E1.012, at Austin, Texas.

The Chair called the meeting to order at 4:45 pm. There being
a quorum present, the following business was transacted.
The Chair laid out SB 1027 and recognized the author, Senator
Lucio, Jr., to explain the bill. Senator Zaffirini sent up a
committee substitute; the Chair recognized Senator Lucio, Jr.
to explain the difference between the committee substitute and
the bill as filed. Senator Zaffirini moved adoption of the
committee substitute, without objection, it was so ordered.
Witnesses testifying and registering on the bill are shown on
the attached list. Senator Sibley moved that SB 1027 do not
pass but that CSSB 1027 be reported back to the Senate with
the recommendation that it do pass and be printed. The motion
carried with a vote of 7 ayes, 0 nays, 0 present not voting,
and 2 absent. Senator Zaffirini moved that the bill be
recommended for placement on the Local & Uncontested Calendar;
without objection, it was so ordered.
At 4:50 pm Senator Zaffirini assumed the chair.
At 4:52 pm Senator Bivins resumed the chair.
Senator Zaffirini moved that the minutes from the prior
meetings be approved; there being no objection, the minutes
were approved.
The Chair laid out HB 1744 and recognized the Senate sponsor,
Senator Gallegos, Jr., to explain the bill. Witnesses
testifying and registering on the bill are shown on the
attached list. Senator Sibley sent up a committee substitute;
the Chair recognized Senator Gallegos, Jr. to explain the
difference between the committee substitute and the bill as
filed. Senator Sibley moved adoption of the committee
substitute, without objection, it was so ordered. The Chair
moved that HB 1744 be left pending to await a quorum; without
objection it was so ordered. Upon arrival of a quorum,
Senator Cain moved that HB 1744 do not pass, but that CSHB
1744 be reported back to the Senate with the recommendation
that it do pass and be printed. The motion carried with a
vote of 7 ayes, 0 nays, 0 present not voting, and 2 absent.
Senator Cain moved that the bill be recommended for placement
on the Local & Uncontested Calendar; without objection, it was
so ordered.
The Chair laid out HB 2181 and recognized the Senate sponsor,
Senator Ellis, to explain the bill. The Chair moved that HB
2181 be left pending to await a quorum; without objection it
was so ordered. Upon arrival of a quorum, Senator Cain moved
that HB 2181 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a vote of 7 ayes, 0 nays, 0 present not voting,
and 2 absent. Senator Cain moved that the bill be recommended
for placement on the Local & Uncontested Calendar; without
objection, it was so ordered.
The Chair laid out HB 713 and recognized the Senate sponsor,

Senator Zaffirini sent up a committee substitute; the Chair
recognized Senator Ellis to explain the difference between the
committee substitute and the bill as filed. Senator Zaffirini
moved adoption of the committee substitute, without objection,
it was so ordered. The Chair moved that HB 713 be left
pending to await a quorum; without objection it was so
ordered. Upon arrival of a quorum, Senator Cain moved that HB
713 do not pass, but that CSHB 713 be reported back to the
Senate with the recommendation that it do pass and be printed.

not voting, and 2 absent.
The subcommittee report on SB 1356 was laid out by Senator
Barrientos. Senator Zaffirini sent up Committee Amendment 1
and moved adoption; without objection, the amendment was
adopted. Senator Zaffirini requested unanimous consent to
incorporate the amendment into the bill to create a committee
substitute; without objection, it was so ordered. Senator
Zaffirini then moved that the new committee substitute be
adopted; without objection, it was so ordered. The Chair
moved that SB 1356 be left pending to await a quorum; without
objection it was so ordered. Upon arrival of a quorum,
Senator Zaffirini moved that SB 1356 do not pass, but that
CSSB 1356 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a vote of 6 ayes, 0 nays, 0 present not voting,
and 3 absent.
The subcommittee report on CSSB 1859 was laid out by Senator
Sibley. The Chair moved that CSSB 1859 be left pending to
await a quorum; without objection it was so ordered. Upon
arrival of a quorum, Senator Sibley moved that CSSB 1859 be
reported back to the Senate with the recommendation that it do
pass and be printed. The motion carried with a vote of 7
ayes, 0 nays, 0 present not voting, and 2 absent. Senator
Sibley moved that the bill be recommended for placement on the

The subcommittee report on CSSB 590 was laid out by Senator
Truan. Senator Zaffirini moved that CSSB 590 be reported
favorably to the Senate with the recommendation that it do
pass and be printed. The motion carried with a vote of 5
ayes, 0 nays, 0 present not voting, and 4 absent.
The Chair laid out SB 777 and recognized Senator Cain, in the
absence of the author, to explain the bill. Witnesses

attached list. Senator Zaffirini moved that SB 777 be
reported favorably to the Senate with the recommendation that
it do pass and be printed. The motion carried with a vote of
6 ayes, 0 nays, 0 present not voting, and 3 absent.
At 7:20 pm Senator Zaffirini assumed the chair.
The Chair laid out HB 3319 and recognized the Senate sponsor,
Senator Bivins, to explain the bill. Senator Bivins moved
that HB 3319 be reported favorably to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a vote of 6 ayes, 0 nays, 0 present not voting,
and 3 absent. Senator Bivins moved that the bill be
recommended for placement on the Local & Uncontested Calendar;
without objection, it was so ordered.
At 7:22 pm Senator Bivins resumed the chair.
There was no action taken on SB 808 by Ellis at the request of
the author.
There was no action taken on the subcommittee report on SB
1655 by Jackson at the request of the author.
There being no further business, at 7:25 pm Senator Bivins
moved that the Committee stand recessed subject to the call of
the Chair. Without objection, it was so ordered.
