         Pursuant to a notice posted in accordance with Senate Rule  
         11.11, a public hearing of the Senate Committee on Education  
         was held on Monday, May 10, 1999 in the Capitol Extension,  
         Room E1.028, at Austin, Texas.

         The Chair called the meeting to order at 10:05 am. The  
         following business was transacted.   
          
         The Chair laid out HB 2664 and recognized the Senate sponsor,  
         Senator Sibley, to explain the bill.  The Chair moved that HB  
         2664 be left pending to await a quorum; without objection it  
         was so ordered.  Upon arrival of a quorum, Senator Sibley  
         moved that HB 2664 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a vote of 5 ayes, 0 nays, 0 present not voting,  
         and 4 absent.  Senator Sibley moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         At 10:10 am Senator Sibley assumed the chair.   
          
         The Chair laid out HB 3158 and recognized Senator Bivins, in  
         the absence of the Senate sponsor, to explain the bill.   
         Senator Bivins sent up Committee Amendment 1 and moved  
         adoption; without objection, the amendment was adopted.  The  
         Chair moved that HB 3158 be left pending to await a quorum;  
         without objection it was so ordered.  Upon arrival of a  
         quorum, Senator Bivins requested unanimous consent to  
         incorporate the amendment into the bill to create a committee  
         substitute;  without objection, it was so ordered.  Senator  
         Bivins then moved that the new committee substitute be  
         adopted; without objection, it was so ordered.  Senator Bivins  
         moved that HB 3158 do not pass but that CSHB 3158 be reported  
         back to the Senate with the recommendation that it do pass and  
         be printed.  The motion carried with a vote of 5 ayes, 0 nays,  
         0 present not voting, and 4 absent.  Senator Sibley moved that  
  
         the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         The Chair laid out HB 964 and recognized Senator Bivins, in  
         the absence of the Senate sponsor, to explain the bill.   
         Witnesses testifying and registering on the bill are shown on  
         the attached list.  The Chair moved that HB 964 be left  
         pending to await a quorum; without objection it was so  
         ordered.  Upon arrival of a quorum, Senator Sibley moved that  
         HB 964 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         vote of 5 ayes, 0 nays, 0 present not voting, and 4 absent.   
         Senator Sibley moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar; without  
         objection, it was so ordered.   
          
         The Chair laid out HB 1409 and recognized the Senate sponsor,  
         Senator Bivins, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         Chair moved that HB 1409 be left pending to await a quorum;  
         without objection it was so ordered.  Upon arrival of a  
         quorum, Senator Bivins moved that HB 1409 be reported back to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 5 ayes, 0 nays, 0  
         present not voting, and 4 absent.  Senator Bivins moved that  
         the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         The Chair laid out HB 1952 and recognized the Senate sponsor,  
         Senator Bivins, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.   
         Senator Bivins sent up Committee Amendment 1 and moved  
         adoption; without objection, the amendment was adopted.   
         Senator Bivins requested unanimous consent to incorporate  
         amendments into the committee substitute;  without objection,  
         it was so ordered.  Senator Bivins then moved that the new  
         committee substitute be adopted; without objection, it was so  
         ordered.  Senator Bivins moved that HB 1952 do not pass but  
         that CSHB 1952 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a vote of 5 ayes, 0 nays, 0 present not voting,  
         and 4 absent.  Senator Bivins moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         At 10:35 am Senator Bivins resumed the chair.   
          
         The Chair laid out HB 3226 and recognized the Senate sponsor,  
         Senator Truan, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         Chair moved that HB 3226 be left pending to await a quorum;  
         without objection it was so ordered.  Upon arrival of a  
         quorum, Senator Sibley moved that HB 3226 be reported back to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 5 ayes, 0 nays, 0  
  
         present not voting, and 4 absent.  Senator Ogden moved that  
         the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         The Chair laid out HB 1840 and recognized the Senate sponsor,  
         Senator Brown, to explain the bill.  The Chair moved that HB  
         1840 be left pending to await a quorum; without objection it  
         was so ordered.  Upon arrival of a quorum, Senator Sibley  
         moved that HB 1840 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a vote of 5 ayes, 0 nays, 0 present not voting,  
         and 4 absent.  Senator Sibley moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         The Chair laid out HB 2359 and recognized the Senate sponsor,  
         Senator West, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         Chair moved that HB 2359 be left pending to await a quorum;  
         without objection it was so ordered.  Upon arrival of a  
         quorum, Senator Sibley moved that HB 2359 be reported back to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 5 ayes, 0 nays, 0  
         present not voting, and 4 absent.  Senator West moved that the  
         bill be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.   
          
         The Chair laid out HB 217 and recognized the Senate sponsor,  
         Senator Ellis, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         Chair moved that HB 217 be left pending; without objection, it  
         was so ordered. 
          
         At 10:55 am Senator Sibley assumed the chair.   
          
         The Chair laid out HB 3138 and recognized the Senate sponsor,  
         Senator Bivins, to explain the bill.  Senator Bivins sent up a  
         committee substitute; the Chair recognized Senator Bivins to  
         explain the difference between the committee substitute and  
         the bill as filed.  Senator Bivins moved adoption of the  
         committee substitute, without objection, it was so ordered.   
         The Chair moved that HB 3138 be left pending; without  
         objection, it was so ordered. 
          
         At 11:05 am Senator Bivins resumed the chair.   
          
         The Chair laid out HB 3263 and recognized the Senate sponsor,  
         Senator Ogden, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.   
         Senator Sibley moved that HB 3263 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 5 ayes, 0 nays, 0 present  
         not voting, and 4 absent.  Senator Ogden moved that the bill  
         be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.   
  
         There being no further business, at 11:15 am Senator Bivins  
         moved that the Committee stand recessed subject to the call of  
         the Chair.  Without objection, it was so ordered.
