Governor's Committee Room ***** Pursuant to a notice posted in accordance with Senate Rule 11.11, a public hearing Senate Subcommittee on Higher Education was held on Monday, April 19, 1999 in LT. Governor's Committee Room , at Austin, Texas. ***** MEMBERS PRESENT: MEMBERS ABSENT: Senator Royce West None Senator Steve Ogden Senator Jane Nelson Senator Bill Ratliff Senator Judith Zaffirini ***** The Chair called the meeting to order at 4:20 pm. There being a quorum present, the following business was transacted. Senator Zaffirini moved that the minutes from the prior hearing be approved; there being no objection, the minutes were approved. The posting rule was suspended on the Senate Floor to hear SB 1861 by Sibley. The Chair laid out SB 1861 and recognized the author, Senator Sibley, to explain the bill. Witnesses testifying and registering on the bill are shown on the attached list. Senator West moved that the bill be left pending until the Committee receive a fiscal note on the bill. Upon receipt of the fiscal note, Senator Nelson moved that SB 1861 be reported favorably to the full Committee with the recommendation that it do pass. The motion carried with a vote of 4 ayes, 0 nays, 0 present not voting, and 1 absent. At 4:25 pm Senator Zaffirini assumed the chair. The Chair laid out SB 1449 and recognized the author, Senator West, to explain the bill. Witnesses testifying and registering on the bill are shown on the attached list. Senator West moved that SB 1449 be left pending; without objection, it was so ordered. At 4:35 pm Senator Ogden assumed the chair. At 4:40 pm Senator West resumed the chair. The Chair laid out SB 1356 and recognized the author, Senator Barrientos, to explain the bill. Witnesses testifying and registering on the bill are shown on the attached list. Senator Ogden moved that SB 1356 be reported favorably to the full Committee with the recommendation that it do pass. The motion carried with a vote of 3 ayes, 1 nay, 0 present not voting, and 1 absent. The Chair laid out SB 1601 and recognized the author, Senator Shapiro, to explain the bill. Witnesses testifying and registering on the bill are shown on the attached list. Senator West moved that SB 1601 be left pending; without objection, it was so ordered. The Chair laid out SB 1655 and recognized the author, Senator Jackson, to explain the bill. Witnesses testifying and registering on the bill are shown on the attached list. Senator Nelson sent up Committee Amendment 1 and moved adoption; without objection, the amendment was adopted. Senator Nelson requested unanimous consent to incorporate amendments into the committee substitute; without objection, it was so ordered. Senator Nelson then moved that the new committee substitute be adopted; without objection, it was so ordered. Senator Nelson moved that SB 1655 do not pass but that CSSB 1655 be reported back to the full Committee with the recommendation that it do pass. The motion carried with a vote of 4 ayes, 0 nays, 0 present not voting, and 1 absent. The Chair laid out SB 1702 and recognized the author, Senator Ellis, to explain the bill. Senator Ogden sent up a committee substitute; the Chair recognized Senator Ellis to explain the difference between the committee substitute and the bill as filed. Senator Ogden moved adoption of the committee substitute, without objection, it was so ordered. Senator Zaffirini sent up Committee Amendment 1 and moved adoption; without objection, the amendment was adopted. Senator Zaffirini sent up Committee Amendment 2 and moved adoption; without objection, the amendment was adopted. Senator Ogden sent up Committee Amendment 3 and moved adoption; without objection, the amendment was adopted. Witnesses testifying and registering on the bill are shown on the attached list. Senator West moved that SB 1702 be left pending awaiting additional changes to the bill; without objection, it was so ordered. The Committee recessed at 5:40 pm. The Committee reconvened at 12:40 pm on Tuesday, April 20th at Senator West's desk to further consider SB 1702 by Ellis. Senator West moved to withdraw the previously adopted committee substitute and amendments to SB 1702, and Senator Ogden sent up a committee substitute; the Chair recognized Senator Ellis to explain the difference between the committee substitute and the bill as filed. Senator Ogden moved adoption of the committee substitute, without objection, it was so ordered. Senator West moved that SB 1702 be left pending; without objection, it was so ordered. There being no further business, at 12:43 pm Senator West moved that the Committee stand recessed subject to the call of the Chair.
