                     SENATE SUBCOMMITTEE ON HIGHER EDUCATION 
                              Monday, May 10, 1999

         Pursuant to a notice posted in accordance with Senate Rule  
         11.11, a public hearing Senate Subcommittee on Higher  
         Education was held on Monday, May 10, 1999 in the Capitol  
         Extension, Room E1.028, at Austin, Texas.

         Senator Royce West                      Senator Bill Ratliff 
         Senator Steve Ogden 
         Senator Jane Nelson

         The Chair called the meeting to order at 11:20 am. The  
         following business was transacted.   
          
         The Chair announced that there would be no action taken on HB  
         1932 by Maxey/Barrientos at the request of the sponsor. 
          
         The Chair laid out HB 3651 and recognized the Senate sponsor,  
         Senator Duncan, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.   
         Senator Ogden sent up a committee substitute; the Chair  
         recognized Senator Duncan to explain the difference between  
         the committee substitute and the bill as filed.  Senator Ogden  
         moved adoption of the committee substitute, without objection,  
         it was so ordered.  The Chair moved to reconsider the vote by  
         which the substitute was adopted and withdraw the substitute;   
         there being no objection the substitute was withdrawn.  The  
         Chair moved that the bill be left pending to await a quorum. 
          
         At 11:35 a.m. the committee recessed until adjournment of the  
         daily Session.   
            
         At 3:07 p.m. the committee reconvened at Senator West's Desk. 
          
         Senator Nelson moved that the minutes from the previous  
         hearing be approved;  there being no objection the minutes  
         were approved. 
          
         Senator Ogden sent up a new committee substitute and moved  
         adoption of the committee substitute, without objection, it  
         was so ordered.  Senator Ogden moved that HB 3651 do not pass  
         but that CSHB 3651 be reported back to the full Committee with  
  
         the recommendation that it do pass.  The motion carried with a  
         vote of 4 ayes, 0 nays, 0 present not voting, and 1 absent.   
          
         There being no further business, at 3:10 pm Senator West moved  
         that the Committee stand recessed subject to the call of the  
         Chair.  Without objection, it was so ordered.
