Pursuant to a notice posted in accordance with Senate Rule
11.11, a public hearing of the Senate Committee on Finance was
held on Thursday, April 15, 1999 in the Capitol Extension,
Room E1.036, at Austin, Texas.

The Chair called the meeting to order at 9:05 a.m. There
being a quorum present, the following business was transacted.
The following members arrived after the roll was called:
Senators Truan, Barrientos, Carona, Duncan and Gallegos.
The Chair laid out SB 113 and recognized the author, Senator
Fraser, to explain the bill.
Senator Fraser sent up a committee substitute; the Chair
recognized Senator Fraser to explain the difference between
the committee substitute and the bill as filed. Senator
Fraser moved adoption of the committee substitute, without
objection, it was so ordered.
Senator Fraser moved that SB 113 do not pass but that CSSB 113
be reported back to the Senate with the recommendation that it
do pass and be printed. The motion carried with a vote of 7
ayes, 1 nay, 3 present not voting, and 0 absent.
Witnesses testifying and registering on the bill are shown on
the attached list.
The Chair laid out SB 9 and recognized the author, Senator
Duncan, to explain the bill.
Senator Duncan moved that SB 9 be reported favorably to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a vote of 8 ayes, 0 nays, 0 present
not voting, and 3 absent.
There were no witnesses present who wished to testify for,
against, or on SB 9.
The Chair laid out SB 868 and recognized the author, Senator
Cain, to explain the bill.
Senator Moncrief sent up a committee substitute; the Chair
recognized Senator Cain to explain the difference between the
committee substitute and the bill as filed. Senator Moncrief
moved adoption of the committee substitute, without objection,
it was so ordered.
Senator Moncrief moved that SB 868 do not pass but that CSSB
868 be reported back to the Senate with the recommendation
that it do pass and be printed. The motion carried with a
vote of 8 ayes, 0 nays, 0 present not voting, and 3 absent.
Senator Moncrief moved that the bill be recommended for
placement on the Local & Uncontested Calendar; without
objection, it was so ordered.

Ogden, to explain the bill.
Senator Ogden sent up a committee substitute. Senator Fraser
moved to reconsider the action taken on a committee
substitute previously adopted; without objection it was so
ordered. The Chair recognized Senator Ogden to explain the
difference between the new committee substitute and the bill
as filed. Senator Ogden moved adoption of the new committee
substitute, without objection, it was so ordered.
Senator Ogden moved that SB 341 do not pass but that CSSB 341
be reported back to the Senate with the recommendation that it
do pass and be printed. The motion carried with a vote of 9
ayes, 0 nays, 0 present not voting, and 2 absent.
Witnesses testified on the bill during the public hearing held
on March 4, 1999.
There was no action taken on SB 1203 and SB 1841.
There being no further business, at 2:45 p.m., Senator Ratliff
moved that the Committee stand recessed subject to the call of
the Chair. Without objection, it was so ordered.
