         Pursuant to a notice posted in accordance with Senate Rule  
         11.11, a public hearing of the Senate Committee on Finance was  
         held on Thursday, April 22, 1999 in the Capitol Extension,  
         Room E1.036, at Austin, Texas.

         At 9:00 a.m. Senator Truan assumed the chair.   
          
         The Chair called the meeting to order at 9:00 a.m.  Upon  
         arrival of a quorum at 9:20 a.m., the Clerk called the roll.   
         There being a quorum present, the following business was  
         transacted.   
          
         The following members arrived after the roll was called:   
         Senators Ratliff and Ogden. 
          
         The Chair laid out SJR 44 and recognized the author, Senator  
         Fraser, to explain the bill.   
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list.   
          
         The Chair moved that SJR 44 be left pending to await a quorum;  
         without objection it was so ordered.  Upon arrival of a  
         quorum, Senator Fraser moved that SJR 44 be reported back to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 9 ayes, 0 nays, 0  
         present not voting, and 2 absent.   
          
         Senator Fraser moved that SJR 44 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 9 ayes, 0 nays, 0 present  
         not voting, and 2 absent.   
          
         The Chair laid out SB 1068 and recognized the author, Senator  
         Fraser, to explain the bill.   
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list.   
          
         The Chair moved that SB 1068 be left pending to await a  
         quorum; without objection it was so ordered.  Upon arrival of  
         a quorum, Senator Fraser moved that SB 1068 be reported back  
         to the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 8 ayes, 0 nays, 0  
         present not voting, and 3 absent.   
          
         The Chair laid out SB 58 and recognized the author, Senator  
         Haywood, to explain the bill.   
          
         Senator Moncrief sent up a committee substitute; the Chair  
         recognized Senator Haywood to explain the difference between  
         the committee substitute and the bill as filed.  Senator  
         Moncrief moved adoption of the committee substitute, without  
         objection, it was so ordered.

         Senator Barrientos moved that SB 58 do not pass but that CSSB  
         58 be reported back to the Senate with the recommendation that  
         it do pass and be printed.  The motion carried with a vote of  
         9 ayes, 0 nays, 0 present not voting, and 2 absent.   
          
         At 9:30 a.m. Senator Ratliff assumed the chair.   
          
         The Chair laid out SB 742 and recognized the author, Senator  
         Armbrister, to explain the bill.   
          
         Senator Moncrief sent up a committee substitute; the Chair  
         recognized Senator Armbrister to explain the difference  
         between the committee substitute and the bill as filed.   
         Senator Moncrief moved adoption of the committee substitute,  
         without objection, it was so ordered.

         Senator Moncrief moved that SB 742 do not pass but that CSSB  
         742 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a

         Senator Moncrief moved that the bill be recommended for  
  
         placement on the Local & Uncontested Calendar; without  
         objection, it was so ordered.   
          
         The Chair laid out HB 844 and recognized the Senate sponsor,  
         Senator Armbrister, to explain the bill.   
         Senator Truan sent up a committee substitute; the Chair  
         recognized Senator Armbrister to explain the difference  
         between the committee substitute and the bill as filed.   
         Senator Truan moved adoption of the committee substitute,  
         without objection, it was so ordered.

         The Committee recessed at 9:55 a.m. for the Senate to convene  
         and reconvened at 1:05 p.m. to continue the public hearing on  
         the following bills. 
          
         At 1:05 p.m. Senator Truan assumed the chair.   
          
         The Chair laid out SB 848 and recognized the author, Senator  
         Nixon, to explain the bill.

         Senator Moncrief  moved to reconsider the vote taken on the  
         adoption of a committee substitute during a previous hearing;  
         without objection it was so ordered.  Senator Moncrief sent up  
         a new committee substitute; the Chair recognized Senator Nixon  
         to explain the difference between the committee substitute and  
         the bill as filed.  Senator Moncrief then moved adoption of  
         the committee substitute, without objection, it was so  
         ordered.

         Senator Lindsay sent up Committee Amendment 1 and moved  
         adoption; without objection, the amendment was adopted.   
         Senator Moncrief moved that SB 1170, as amended, be reported  
         back to the Senate with the recommendation that it do pass and  
         be printed.  The motion carried with a vote of 8 ayes, 0 nays,  
         0 present not voting, and 3 absent.   
          
         Senator Moncrief moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar; without  
         objection, it was so ordered.

         a quorum, Senator Truan moved that SJR 36 do not pass but that  
         CSSJR 36 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a vote of 7 ayes, 0 nays, 0 present not voting,  
         and 4 absent.   
          
         The Chair laid out SB 1462 and recognized the author, Senator  
         Cain, to explain the bill.

         The Chair moved that SB 1462 be left pending to await a  
         quorum; without objection it was so ordered.  Upon arrival of  
         a quorum, Senator Truan moved that SB 1462 be reported back to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 7 ayes, 0 nays, 0  
         present not voting, and 4 absent.   
          
         The Chair laid out SJR 40 and recognized the author, Senator  
         Ogden, to explain the bill.

         Senator Moncrief moved that SJR 40 be left pending; without  
         objection, it was so ordered.

         Ogden, to explain the bill.   
          
         Senator Ogden sent up Committee Amendment 1 and moved  
         adoption; without objection, the amendment was adopted.

         adoption; without objection, the amendment was adopted.

         the absence of the author, to explain the bill.

         Senator Moncrief moved that SB 1464 be reported favorably to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 8 ayes, 0 nays, 0

         No action was taken on SB 1145. 
          
         There being no further business, at 2:50 p.m. Senator Moncrief  
         moved that the Committee stand recessed subject to the call of  
         the Chair.  Without objection, it was so ordered.
