Pursuant to a notice posted in accordance with Senate Rule
11.11, a public hearing of the Senate Committee on State
Affairs was held on Thursday, February 11, 1999 in the Senate
Chamber at Austin, Texas.

The Chair called the meeting to order at 11:00 am. The
following members arrived after the roll was called: Senator
Shapleigh, Senator Brown, Senator Cain, Senator Haywood,
Senator Lucio and Senator Wentworth.
There being a quorum present, the following business was
transacted.
The Chair laid out committee rules seven, eight and nine and
advised that there had been one change made to rule number
seven. The Chair recognized Senator Cain to explain the
change. Senator Shapleigh moved that the remaining three
rules be adopted. There being no objection, the rules were
adopted.
The Chair laid out SB 97 and recognized the author, Senator
Harris, to explain the bill.
Witnesses testifying and registering on the bill are shown on
the attached list.
Senator Lucio, Jr. moved that SB 97 be reported favorably to
the Senate with the recommendation that it do pass and be
printed. The motion carried with a vote of 8 ayes, 0 nays, 0
present not voting, and 1 absent.
The Chair laid out SJR 15 and recognized the author, Senator
Harris, to explain the bill.
Senator Lucio, Jr. sent up a committee substitute; the Chair
recognized Senator Harris to explain the difference between
the committee substitute and the bill as filed. Senator Cain
moved adoption of the committee substitute, without objection,
it was so ordered.
Witnesses testifying and registering on the bill are shown on
the attached list.
Senator Lucio, Jr. moved that SJR 15 do not pass but that
CSSJR 15 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a vote of 8 ayes, 0 nays, 0 present not voting,
and 1 absent.
The Chair laid out SB 100 and recognized the author, Senator
Carona, to explain the bill.
Senator Shapiro moved that SB 100 be left pending; without
objection, it was so ordered.
The Chair laid out SB 166 and recognized the author, Senator
Carona, to explain the bill.
Senator Shapiro sent up a committee substitute; the Chair
recognized Senator Carona to explain the difference between
the committee substitute and the bill as filed. Senator
Shapiro moved adoption of the committee substitute, without
objection, it was so ordered.

Senator Lucio, Jr. moved that SB 166 do not pass but that CSSB
166 be reported back to the Senate with the recommendation
that it do pass and be printed. The motion carried with a
vote of 8 ayes, 0 nays, 0 present not voting, and 1 absent.
The Chair laid out SB 239 and recognized the author, Senator
Ellis, to explain the bill.
Witnesses testifying and registering on the bill are shown on
the attached list.
Senator Shapiro moved that SB 239 be left pending; without
objection, it was so ordered.
SB 246 was pulled down at the request of the author, Senator
Ellis.
The Chair laid out SB 211 and recognized the author, Senator
Duncan, to explain the bill.
Senator Shapleigh moved that SB 211 be reported favorably to
the Senate with the recommendation that it do pass and be
printed. The motion carried with a vote of 7 ayes, 0 nays, 0
present not voting, and 2 absent.
The Chair laid out SB 382 and recognized the author, Senator
Duncan, to explain the bill.
Senator Bernsen sent up Committee Amendment 1 and moved
adoption; without objection, the amendment was adopted.
Witnesses testifying and registering on the bill are shown on
the attached list.
Senator Bernsen moved that SB 382, as amended, be reported
back to the Senate with the recommendation that it do pass and
be printed. The motion carried with a vote of 7 ayes, 0 nays,
0 present not voting, and 2 absent.
At 12:05 pm Senator Shapleigh assumed the chair.
At 12:10 pm Senator Shapiro resumed the chair.
The Chair called invited testimony only on the Y2K state
agency compliance issue.
Witnesses testifying and registering on the this issue are
shown on the attached list.
There being no further business, at 12:45 pm Senator Shapleigh
moved that the Committee stand recessed subject to the call of
the Chair. Without objection, it was so ordered.
