         Pursuant to a notice posted in accordance with Senate Rule  
         11.11, a public hearing of the Senate Committee on State  
         Affairs was held on Thursday, March 4, 1999 in the Senate  
         Chamber at Austin, Texas.

         The Chair called the meeting to order at 12:05 pm.  There  
         being a quorum present, the following business was transacted.   
          
         The following members arrived after the roll was called:  
         Senator Bernsen, Senator Brown, Senator Shapleigh and Senator  
         Wentworth. 
          
         Senator Cain moved approval of the minutes for the March 2,  
         1999, State Affairs Committee meeting.  There being no  
         objection, the minutes were approved. 
          
         The Chair referred the following bill to the Standing  
         Subcommittee on Infrastructure: 
         SB 735 by Armbrister 
          
         The Chair laid out the subcommittee report on CSSB 21 and  
         recognized Senator Cain, Chair of the Subcommittee, to explain  
         the bill.   
          
         Senator Cain moved adoption of the subcommittee report on CSSB  
         21.  There being no objection, it was so ordered. 
         Senator Cain moved that SB 21 do not pass but that CSSB 21 be  
         reported back to the Senate with the recommendation that it do  
         pass and be printed.  The motion carried with a vote of 6  
  
         ayes, 0 nays, 0 present not voting, and 3 absent.  Senator  
         Cain moved that the bill be recommended for placement on the  
         Local & Uncontested Calendar; without objection, it was so  
         ordered.   
          
         The Chair laid out subcommittee report on SB 74 and recognized  
         Senator Cain, Chair of the Subcommittee, to explain the bill.   
          
         Senator Cain moved adoption of the subcommittee report on SB  
         74.  There being no objection, it was so ordered. 
          
         Senator Lucio, Jr. moved that SB 74 be reported favorably to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 6 ayes, 0 nays, 0  
         present not voting, and 3 absent.   
          
         The Chair laid out subcommittee report on CSSB 132 and  
         recognized Senator Cain, Chair of the Subcommittee, to explain  
         the bill.   
          
         Senator Cain moved adoption of the subcommittee report on CSSB  
         132.  There being no objection, it was so ordered. 
          
         Senator Lucio, Jr. moved that SB132 do not pass but that  
         CSSB132 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         vote of 6 ayes, 0 nays, 0 present not voting, and 3 absent.   
          
         The Chair laid out subcommittee report on SB 155 as amended  
         and recognized Senator Cain, Chair of the Subcommittee, to  
         explain the bill.   
          
         Senator Cain moved adoption of the subcommittee report on SB  
         155 as amended.  There being no objection, it was so ordered. 
          
         Senator Cain moved that SB 155, as amended, be reported back  
         to the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of  7 ayes, 0 nays, 0  
         present not voting, and 2 absent.   
          
         The Chair laid out subcommittee report on SB 322 and  
         recognized Senator Cain, Chair of the Subcommittee, to explain  
         the bill.   
          
         Senator Cain moved adoption of the subcommittee report on SB  
         322.  There being no objection, it was so ordered. 
          
         Senator Cain moved that SB 322 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 7 ayes, 0 nays, 0 present  
         not voting, and 2 absent. Senator Cain moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         The Chair laid out subcommittee report on SB 450 and  
         recognized Senator Cain, Chair of the Subcommittee, to explain  
         the bill.   
          
         Senator Cain moved adoption of the subcommittee report on SB  
         450.  There being no objection, it was so ordered. 
          
         Senator Cain moved that SB 450 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 7 ayes, 0 nays, 0 present  
         not voting, and 2 absent. 
          
         The Chair laid out subcommittee report on CSSB 537 and  
         recognized Senator Cain, Chair of the Subcommittee, to explain  
         the bill.   
          
         Senator Cain moved adoption of the subcommittee report on CSSB  
         537.  There being no objection, it was so ordered. 
          
         Senator Lucio, Jr. moved that SB 537 do not pass but that CSSB  
         537 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         vote of 7 ayes, 0 nays, 0 present not voting, and 2 absent.   
          
         The Chair laid out SB 355 and recognized the author, Senator  
         Harris, to explain the bill.   
          
         Senator Lucio, Jr. moved that SB 355 be reported favorably to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 7 ayes, 0 nays, 0  
         present not voting, and 2 absent.   
          
         The Chair laid out SB 117 as amended  and recognized the  
         author, Senator Lucio, Jr., to explain the bill.   
          
         Senator Lucio moved that SB 117, as amended, be reported back  
         to the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of  7 ayes, 0 nays, 0  
         present not voting, and 2 absent.   
          
         The Chair laid out SB 57 and recognized the author, Senator  
         Harris, to explain the bill.

         Senator Shapleigh moved that SB 57 be reported favorably to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 8 ayes, 0 nays, 0

         that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         The Chair laid out SB 277 and recognized the author, Senator  
         Carona, to explain the bill.   
          
         Senator Bernsen sent up a committee substitute; the Chair  
         recognized Senator Carona to explain the difference between  
         the committee substitute and the bill as filed.

         Senator Shapiro moved that SB 277 be left pending; without  
         objection, it was so ordered.

         Carona, to explain the bill.

         West, to explain the bill.   
          
         Senator Shapleigh sent up a committee substitute; the Chair  
         recognized Senator West to explain the difference between the  
         committee substitute and the bill as filed.

         Senator Shapiro moved that SB 439 be left pending; without  
         objection, it was so ordered. 
          
         The Chair laid out SB 183 and recognized the author, Senator  
         Nixon, to explain the bill.

         Senator Nixon moved that SB 183 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.

         be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.   
          
         The Chair laid out SB 613 and recognized the author, Senator  
         Carona, to explain the bill.   
          
         Senator Cain sent up Committee Amendment 1 and moved adoption;  
         without objection, the amendment was adopted.  Senator Lucio,  
         Jr. moved that SB 613, as amended, be reported back to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 7 ayes, 0 nays, 0 present  
  
         not voting, and 2 absent.   
          
         There being no further business, at 1:25 pm Senator Shapleigh  
         moved that the Committee stand recessed subject to the call of  
         the Chair.  Without objection, it was so ordered.
