         Pursuant to a notice posted in accordance with Senate Rule  
         11.11, a public hearing of the Senate Committee on Health  
         Services was held on Tuesday, March 2, 1999, in the Capitol  
         Extension, Room E1.016, at Austin, Texas.

         The Chair called the meeting to order at 1:30 p.m.  There  
         being a quorum present, the following business was transacted.   
          
         The following members arrived after the roll was called:   
         Senator Lindsay and Senator Madla. 
          
         The Chair laid out the February 23, 1999, minutes and  
         recognized Senator Moncrief who moved for their approval.   
         There being no objection, the motion prevailed by unanimous  
         consent. 
          
         The Chair laid out the Subcommittee Report on SB 93 and  
         recognized Senator Moncrief to explain the report.  Senator  
         Moncrief moved that the Subcommittee Report on SB 93 be  
         adopted.  There being no objection, the motion prevailed.    
         The Chair laid out the Committee Substitute for SB 93 as  
         reported from subcommittee.  Senator Moncrief moved adoption  
         of the committee substitute for SB 93; without objection, it  
         was so ordered. 
          
         Senator Moncrief moved that SB 93 do not pass, but that CSSB  
         93 be reported back to the Senate with the recommendation that  
         it do pass and be printed.  The motion carried with a vote of  
         5 ayes, 0 nays, 0 present not voting, and 0 absent.   
          
         At 1:35 p.m., Senator Moncrief assumed the chair.   
          
         The Chair laid out SB 556 and recognized the bill's author,  
  
         Senator Nelson, to explain her bill.   
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list.   
          
         Senator Nelson moved that SB 556 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 5 ayes, 0 nays, 0 present  
         not voting, and 0 absent.   
          
         Senator Nelson moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar; without  
         objection, it was so ordered.   
          
         At 1:40 p.m., Senator Nelson resumed the chair.   
          
         The Chair laid out SB 314 and recognized Senator Moncrief, in  
         the absence of the author, to explain the bill.   
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list.   
          
         Senator Moncrief moved that SB 314 be reported favorably to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 5 ayes, 0 nays, 0  
         present not voting, and 0 absent.   
          
         Senator Moncrief moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar; without  
         objection, it was so ordered.   
          
         The Chair laid out SB 44 and recognized the author, Senator  
         Shapiro, to explain the bill.   
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list.   
          
         Senator Moncrief sent up Committee Amendment 1 and moved  
         adoption; without objection, the amendment was adopted.  
          
         Senator Nelson sent up a committee amendment and explained the  
         proposed amendment. Senator Nelson then withdrew her  
         amendment.  Senator Moncrief moved that SB 44 be left pending,  
         subject to the call of the Chair; without objection, it was so  
         ordered. 
          
         The Chair laid out SB 310 and recognized the bill's author,  
         Senator Cain, to explain the bill.   
         There were no witnesses testifying or registering on the bill. 
          
         Senator Madla moved that SB 310 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 5 ayes, 0 nays, 0 present  
         not voting, and 0 absent.   
  
         Senator Madla moved that the bill be recommended for placement  
         on the Local & Uncontested Calendar.  Due to an objection,  
         Senator Madla withdrew the motion.  
          
         The Chair recalled SB 44 which had been left pending before  
         the committee and laid it out for consideration.  Senator  
         Moncrief requested unanimous consent to incorporate the  
         previously adopted amendment into a committee substitute for  
         SB 44;  without objection, it was so ordered.  Senator  
         Moncrief then moved that the committee substitute for SB 44 be  
         adopted; without objection, it was so ordered.   
          
         Senator Moncrief moved that SB 44 do not pass, but that CSSB  
         44 be reported back to the Senate with the recommendation that  
         it do pass and be printed.  The motion carried with a vote of  
         5 ayes, 0 nays, 0 present not voting, and 0 absent.   
          
         There being no further business, at 2:23 p.m., Senator  
         Moncrief moved that the Committee stand recessed, subject to  
         the call of the Chair.  Without objection, it was so ordered.
