         Pursuant to a notice posted in accordance with Senate Rule  
         11.11, a public hearing of the Senate Committee on Health  
         Services was held on Tuesday, April 27, 1999, in the Capitol  
         Extension, Room E1.016, at Austin, Texas.

         The Chair called the meeting to order at 2:36 p.m.  There  
         being a quorum present, the following business was transacted.   
          
         The following members arrived after the roll was called:   
         Senator Nixon. 
          
         The Chair laid out the April 20,1999, minutes and recognized  
         Senator Moncrief who moved for their approval.  There being no  
         objection, the motion prevailed by unanimous consent. 
          
         The Chair laid out SB 458 and recognized the bill's author,  
         Senator Moncrief, to explain the bill.   
          
         Senator Moncrief sent up a committee substitute; the Chair  
         recognized Senator Moncrief to explain the difference between  
         the committee substitute and the bill as filed.  Senator  
         Moncrief moved adoption of the committee substitute; without  
         objection, it was so ordered. 
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list.  At Senator Moncrief's request, public  
         testimony was left open on the bill. 
          
         Senator Moncrief moved that SB 458 be left pending; without  
         objection, it was so ordered. 
          
         The Chair laid out HB 1401 and recognized Senator Madla, in  
         the absence of the Senate sponsor, to explain the bill.   
  
         Witnesses testifying and registering on the bill are shown on  
         the attached list.   
          
         Senator Madla moved that HB 1401 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 5 ayes, 0 nays, 0 present  
         not voting, and 0 absent.   
          
         Senator Madla moved that the bill be recommended for placement  
         on the Local & Uncontested Calendar; without objection, it was  
         so ordered.   
          
         The Chair laid out SB 1331 and recognized the author, Senator  
         Moncrief, to explain the bill.

         Senator Moncrief moved that SB 1331 be reported favorably to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 5 ayes, 0 nays, 0

         The Chair laid out HB 1342 and recognized the Senate sponsor,  
         Senator Moncrief, to explain the bill.

         Senator Moncrief sent up Committee Amendment 1 and moved  
         adoption; without objection, the amendment was adopted.   
          
         Senator Moncrief moved that HB 1342, as amended, be reported  
         back to the Senate with the recommendation that it do pass and  
         be printed.  The motion carried with a vote of 5 ayes, 0 nays,  
         0 present not voting, and 0 absent.   
          
         Senator Moncrief moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar; without  
         objection, it was so ordered.   
          
         The Chair laid out HB 2085 and recognized the Senate sponsor,  
         Senator Brown, to explain the bill.   
          
         Senator Moncrief sent up a committee substitute; the Chair  
         recognized Senator Brown to explain the difference between the  
         committee substitute and the bill as filed.  Senator Moncrief  
         moved adoption of the committee substitute; without objection,

         adoption; without objection, the amendment was adopted.   
          
         Senator Madla sent up Committee Amendment 4 and moved  
         adoption; without objection, the amendment was adopted.   
          
         Senator Madla sent up Committee Amendment 5 and moved  
         adoption; without objection, the amendment was adopted.   
          
         Senator Madla requested unanimous consent to incorporate  
         amendments into the committee substitute;  without objection,  
         it was so ordered.  Senator Madla then moved that the new  
         committee substitute be adopted; without objection, it was so  
         ordered.   
          
         Senator Madla moved that HB 2085 do not pass, but that CSHB  
         2085 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         vote of 5 ayes, 0 nays, 0 present not voting, and 0 absent.   
          
         The Chair laid out SB 566 and recognized the bill's author,  
         Senator Moncrief, to explain the bill.   
          
         Senator Moncrief sent up a committee substitute; the Chair  
         recognized Senator Moncrief to explain the difference between  
         the committee substitute and the bill as filed.  Senator  
         Moncrief moved adoption of the committee substitute; without  
         objection, it was so ordered.

         Senator Moncrief moved that SB 566 be left pending; without  
         objection, it was so ordered. 
          
         At 5:00 p.m., Senator Moncrief assumed the chair.   
         The Chair laid out HB 1400 and recognized Senator Nelson, in  
         the absence of the Senate sponsor, to explain the bill.

         Senator Nelson sent up Committee Amendment 1 and moved  
         adoption; without objection, the amendment was adopted.   
          
         Senator Nelson requested unanimous consent to incorporate

         substitute be adopted; without objection, it was so ordered.

         vote of 4 ayes, 0 nays, 0 present not voting, and 0 absent.

         adopted previously by the committee.

         adoption; without objection, the amendment was adopted.  
          
         Senator Moncrief requested unanimous consent to incorporate  
         the amendments into a committee substitute;  without  
         objection, it was so ordered.  Senator Moncrief then moved  
         that the committee substitute be adopted; without objection,  
         it was so ordered.   
          
         Senator Moncrief moved that SB 1207 do not pass, but that CSSB  
         1207 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         vote of 5 ayes, 0 nays, 0 present not voting, and 0 absent.   
          
         Senator Moncrief moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar; without  
         objection, it was so ordered.   
          
         Senator Madla moved that SB 703 be left pending; without  
         objection, it was so ordered. 
          
         The Chair laid out SB 1618 and recognized the bill's author,  
         Senator Cain, to explain the bill.   
          
         Senator Moncrief sent up a committee substitute; the Chair  
         recognized Senator Cain to explain the difference between the  
         committee substitute and the bill as filed.  Senator Moncrief  
         moved adoption of the committee substitute; without objection,  
         it was so ordered. 
          
         Senator Moncrief moved that SB 1618 do not pass, but that CSSB  
         1618 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         vote of 5 ayes, 0 nays, 0 present not voting, and 0 absent.   
          
         There being no further business, at 5:30 p.m., Senator Nixon  
         moved that the Committee stand recessed subject to the call of  
         the Chair.  Without objection, it was so ordered.
