           SENATE SPECIAL COMMITTEE ON ELECTRIC UTILITY RESTRUCTURING 
                            Monday, February 15, 1999

         Pursuant to a notice posted in accordance with Senate Rule  
         11.11, a public hearing of the Senate Special Committee on  
         Electric Utility Restructuring was held on Monday, February  
         15, 1999 in the Senate Chamber at Austin, Texas.

         The Chairman called the meeting to order at 9:35 am.  There  
         being a quorum present, the following business was transacted.   
          
         Chairman Sibley laid out SB 86 and recognized the author,  
         Senator Nelson.  Senator Nelson sent up a proposed committee  
         substitute and explained  the difference between the committee  
         substitute and the bill as filed. 
          
         The Chairman then called Pat Wood, Chairman of the Public  
         Utility Commission, and Public Utility Commissioner Judy Walsh  
         to testify as resource witnesses and to respond to members'  
         questions and concerns. 
          
         At 10:25 am Chairman Sibley advised that public testimony  
         would commence and called the first witness.  Witnesses  
         testifying and registering on the bill are shown on the  
         attached list.   
          
         At 11:25 am the Chairman moved that public testimony be closed  
         and that the Committee stand recessed until 30 minutes after  
         adjournment of the Senate.  Without objection, it was so  
         ordered. 
          
         The Committee reconvened at 3:55 pm and Chairman Sibley  
         recognized Senator Nelson.  Senator Nelson withdrew the  
         proposed committee substitute for SB 86, sent up a new  
  
         committee substitute and explained the difference between the  
         new substitute and the proposed substitute.  Senator Nelson  
         moved that the new committee substitute be adopted; without  
         objection, it was so ordered.  Senator Nelson then moved that  
         SB 86 do not pass but that CSSB 86 be reported back to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a vote of 6 ayes, 0 nays, 0 present  
         not voting, and 1 absent.   
          
         There being no further business, at 4:40 pm Chairman Sibley  
         moved that the Committee stand recessed subject to the call of  
         the Chairman.  Without objection, it was so ordered.
