Amend CSHB 2 as follows: (1) On page 29, line 20, strike "Section 255.009" and substitute "Sections 255.009 and 255.010". (2) On page 30, between lines 9 and 10, insert the following: Sec. 255.010. DISCLOSURE FOR CERTAIN TELEPHONE COMMUNICATIONS. (a) A candidate or an authorized representative of a candidate or a specific-purpose committee affiliated with a candidate who engages in a telephone communication for the purpose of soliciting political contributions or that has the effect of supporting or opposing the nomination or election of a candidate or the passage or defeat of a measure shall disclose the following at the end of the communication: (1) the identity of the individual who is calling and the person with whom the individual is affiliated, if any; (2) the identity of the person who paid for the telephone communication, including as appropriate: (A) the name of the political committee, if any; and (B) if the person paying for the telephone communication is not a candidate or a political committee affiliated with a candidate, a statement as to whether the candidate authorized the communication; (3) the name, telephone number, and address of an individual whom the recipient of the telephone communication may contact for additional information about the communication. (b) A person who, on behalf of, at the direction of, or in cooperation with a political committee engages in a telephone communication for the purpose of soliciting political contributions or that has the effect of supporting or opposing the nomination or election of a candidate or the passage or defeat of a measure shall disclose the following at the end of the communication: (1) the identity of the individual who is calling and the person with whom the individual is affiliated, if any; (2) the identity of the person who paid for the telephone communication, including as appropriate: (A) the name of the political committee, if any; and (B) if the person paying for the telephone communication is not a candidate or a political committee affiliated with a candidate, a statement as to whether the candidate who benefits from the communication authorized the communication; (3) the name, telephone number, and address of an individual whom the recipient of the telephone communication may contact for additional information about the communication. (c) The commission shall adopt rules to enforce this section. (d) A person who violates this section is liable for a civil penalty not to exceed $500 for each violation.
