Amend CSHB 6 as follows: (1) In SECTION 2 of the bill (Senate Committee report, page 1, line 26), between "12.1071" and "and", insert ", 12.1101, 12.1131, 12.1141,". (2) In SECTION 2 of the bill, immediately before added Section 12.121, Education Code (Senate Committee report, page 1, between lines 44 and 45), insert the following: Sec. 12.1101. NOTIFICATION OF CHARTER APPLICATION. (a) The commissioner by rule shall adopt a procedure for providing notice to the following persons on receipt by the State Board of Education of an application for a charter for an open-enrollment charter school under Section 12.110: (1) the board of trustees of each school district from which the proposed open-enrollment charter school is likely to draw students, as determined by the commissioner; (2) the regional education service center primarily responsible for serving the proposed school; (3) each member of the legislature that represents the geographic area to be served by the proposed school, as determined by the commissioner; and (4) any other interested person, as determined by the commissioner. (b) The notice provided under this section must include the following information related to the proposed open-enrollment charter school: (1) the proposed name of the school; (2) the proposed physical address of the school; (3) the anticipated enrollment of the school; (4) the grade levels to be offered by the school; (5) the proposed size and student-teacher ratio of classes at the school; (6) the educational program to be offered by the school, including the number of hours of instruction to be provided to students each school day; (7) the type of charter applied for by the school; (8) the name and address of the person applying for the charter; and (9) a local contact person for the school. Sec. 12.1131. NOTIFICATION OF DECISION TO GRANT CHARTER. (a) The commissioner by rule shall adopt a procedure for providing notice to the following persons of a decision by the State Board of Education to grant a charter for an open-enrollment charter school under Section 12.101: (1) the board of trustees of each school district from which the open-enrollment charter school is likely to draw students, as determined by the commissioner; (2) the regional education service center primarily responsible for serving the school; (3) each member of the legislature that represents the geographic area to be served by the school, as determined by the commissioner; and (4) any other interested person, as determined by the commissioner. (b) The notice provided under this section must include the following information related to the open-enrollment charter school: (1) the name of the school; (2) the physical address of the school; (3) the anticipated enrollment of the school; (4) the grade levels to be offered by the school; (5) the proposed size and student-teacher ratio of classes at the school; (6) the educational program to be offered by the school, including the number of hours of instruction to be provided to students each school day; (7) the type of charter granted for the school; (8) the name and address of the person to whom the charter was granted; and (9) a local contact person for the school. Sec. 12.1141. NOTIFICATION OF DECISION TO APPROVE REVISION. (a) The commissioner by rule shall adopt a procedure for providing notice to the following persons of a decision by the State Board of Education to approve the revision of an open-enrollment charter school's proposed charter under Section 12.114: (1) the board of trustees of each school district from which the open-enrollment charter school draws students, as determined by the commissioner; (2) the regional education service center primarily responsible for serving the open-enrollment charter school; (3) each member of the legislature that represents the geographic area served by the open-enrollment charter school, as determined by the commissioner; and (4) any other interested person, as determined by the commissioner. (b) The notice provided under this section must include general information related to the proposed charter revision, including whether any additional sites or campuses are approved. (3) Immediately before SECTION 7 of the bill (Senate Committee report, page 5, between lines 29 and 30), insert the following appropriately numbered SECTION and renumber the subsequent SECTIONS of the bill accordingly: SECTION __. Sections 12.1101, 12.1131, and 12.1141, Education Code, as added by this Act, apply only to an application for a charter for an open-enrollment charter school received by the State Board of Education or a charter for an open-enrollment charter school granted by the board or a charter revision approved by the board on or after the effective date of this Act. An application received or a charter granted or a revision approved before the effective date of this Act is governed by the law as it existed immediately before the effective date of this Act, and that law is continued in effect for that purpose.
