Amend CSHB 2134 by adding a new Section 7 and a new Section 8
as follows, renumbering the subsequent sections, lines, pages,
etc., to accommodate these new sections:
      SECTION 7. Subchapter A, Chapter 548, Transportation Code, is
amended by adding Section 548.006 to read as follows:
      Sec. 548.006. ADVISORY COMMITTEE. (a) An advisory committee
consisting of six members shall:
            (1) advise the department on the department's rules
relating to the certification of inspection stations and inspectors
and operations of the emissions testing program under this chapter;
            (2) make recommendations to the department relating to
the content of rules involving the operation of the emissions
testing program and certification of inspection stations and
inspectors; and
            (3) perform any other advisory function requested by
the department in administering this chapter.
      (b) The commissioners shall appoint three members of the
committee as follows:
            (1) one person to represent inspection station owners
and operators;
            (2) one person to represent manufacturers of motor
vehicle emissions inspection devices; and
            (3) one person to represent the public interest.
      (c) Each member of the conservation commission shall appoint
one member of the committee. The member appointed by the presiding
officer of the conservation commission shall serve as the presiding
officer of the committee.
      (d) Committee members serve staggered three-year terms.
      (e) A vacancy on the committee is filled in the same manner
as other appointments to the committee.
      (f) A member of the committee is not entitled to
compensation, but is entitled to reimbursement of the member's
travel expenses as provided in the General Appropriations Act for
state employees.
      (g) The committee may elect an assistant presiding officer
and a secretary from among its members and may adopt rules for the
conduct of its own activities.
      (h) The committee is entitled to review and comment on rules
to be considered for adoption by the commission of the department
under Subchapter F or G before the rules are proposed.
      SECTION 8. (a) Not later than January 1, 2002, the public
safety commissioners shall appoint to the advisory committee
created under Section 548.006, Transportation Code, as added by
this Act:
            (1) a representative of inspection station owners and
operators to serve a one-year term;
            (2) a representative of manufacturers of motor vehicle
emissions inspection devices to serve a two-year term; and
            (3) a representative of the public interest to serve a
three-year term.
      (b) Not later than January 1, 2002, the members of the Texas
Natural Resource Conservation Commission shall appoint members to
the advisory committee created under Section 548.006,
Transportation Code, as added by this Act, as follows:
            (1) the presiding officer of the commission shall
appoint a member to a three-year term;
            (2) one member other than the presiding officer shall
appoint a member to a one-year term; and
            (3) one member other than the presiding officer shall
appoint a member to a two-year term.
