Amend SB 139 by adding the following appropriately numbered
SECTION of the bill and renumbering the remaining SECTIONS of the
bill as appropriate:
      SECTION __.  Section 42.072(b), Penal Code, is amended to
read as follows:
      (b)  An offense under this section is a felony of the third
degree <Class A misdemeanor>, except that the offense is a felony
of the second <third> degree if the actor has previously been
convicted under this section.
