Amend CSSB 310 on page 10 between SECTIONS 6 and 7 of the bill by inserting the following section, appropriately numbered, and renumbering the subsequent sections accordingly: SECTION __. Subchapter C, Chapter 81, Natural Resources Code, is amended by adding Section 81.056 to read as follows: Sec. 81.056. PIPELINE CONSTRUCTION AND OPERATION PUBLIC NOTIFICATION REQUIREMENTS. (a) Subsections (b) and (c) apply only to a part of a pipeline system that crosses more than three counties for which construction began after September 1, 2001. (b) A pipeline operator must publish notice in a newspaper of general circulation in each county with a population greater than 10,000 that contains part of the proposed route of the pipeline system. The notice shall be published in the form prescribed by the commission and include the location of the beginning and end points of the proposed part of the system and a listing of each state or federal highway that will be crossed by the proposed part of the system. The notice must be published at least thirty days but no more than one year before the start of construction. (c) Before approving any permit for the operation of a pipeline required by this chapter or the rules adopted under it, the commission must: (1) certify that at least ninety days but no more than one year before the date the commission approves the permit the person requesting the permit has provided a copy of the application to: (A) the county judge of each county that contains part of the proposed route; (B) the county fire marshal in each county that contains part of the proposed route, if such office has been established by that county; and (C) the regional water planning group established by Sec. 16.053, Texas Water Code, in each regional water planning area that contains part of the proposed route; and (2) review and consider comments from members of the public regarding the project for which the permit is being requested.
