Amend Amendment No. 5 by Farabee, in the SECTION of the bill
added by the amendment, by striking Subsection (c) of the section
(page 4, lines 18-29) and substituting the following:
      (c)  This section takes effect immediately if this Act
receives a vote of two-thirds of all the members elected to each
house, as provided by Section 39, Article III, Texas Constitution.
If this Act does not receive the vote necessary for immediate
effect, this section takes effect September 1, 2001.
      (d)  The changes in law made by Sections 91.104(a) and (b)
and 91.109, Natural Resources Code, as amended by this section,
apply only to a person required on or after the effective date of
this section to file a bond or alternate financial security under
Section 91.103, Natural Resources Code.  A person required to file
a bond or alternate financial security under that section before
that date is governed by the law in effect on the date the bond or
security is required to be filed, and the former law is continued
in effect for that purpose.  The changes made by Section 91.104(c),
Natural Resources Code, as added by this section, apply on or after
the effective date of this section to a person required by that
section to file a bond, letter of credit, or cash deposit.
