Amend CSSB 507 as follows:
      (1)  In SECTION 1 of the bill, in added Section
209.006(b)(2)(A), Property Code (House Committee Report, page 6,
lines 22-24), strike "unless the owner was given notice and a
reasonable opportunity to cure a similar violation within the
preceding 12 months".
      (2)  In SECTION 1 of the bill, in added Section
209.011(d)(3), Property Code (House Committee Report, page 11, line
27), strike "including reasonable" and substitute "excluding".
      (3)  In SECTION 1 of the bill, in added Section
209.011(e)(1)(C), Property Code (House Committee Report, page 12,
line 24), strike "including reasonable" and substitute "excluding".
      (4)  In SECTION 1 of the bill, add a new Section 209.013,
Property Code (House Committee Report, page 17, between lines 9 and
10)  to read as follows:
      Sec. 209.013.  EXTENSION OF, ADDITION TO, OR MODIFICATION OF
RESTRICTIONS; PENALTY. (a)  Unless otherwise provided by the
restrictions or the property owners' association's articles of
incorporation or bylaws, before the extension of, addition to, or
modification of the restrictions governing a residential
subdivision may take effect:
            (1)  the association shall provide to the property
owners in the residential subdivision notice and an opportunity to
be heard; and
            (2)  the extension of, addition to, or modification of
the restrictions must be approved by the owners who own in the
aggregate at least 75 percent of the lots in the residential
subdivision.
      (b)  A member of the governing board of the association who
violates Subsection (a)  is subject to a civil penalty in an amount
not to exceed $5,000 for each violation.
