Amend SB 676, House Committee Report, as follows:
      (1)  In SECTION 2 of the bill, strike the introductory
language (page 2, lines 7 and 8), and substitute the following:
      SECTION 2. Section 39.027, Education Code, is amended by
amending Subsections (a)  and (e) and adding Subsection (g) to read
as follows:
      (2)  In SECTION 2 of the bill, in amended Subsection (a)(3),
Section 39.027, Education Code (page 2, line 25), between "Section
39.023(a)" and "for", insert "or (l)".
      (3)  In SECTION 2 of the bill, in amended Subsection (a)(4),
Section 39.027, Education Code (page 3, line 5), between "Section
39.023(a)" and "for", insert "or (l)".
      (4)  In SECTION 2 of the bill, in amended Subsection (a)(4),
Section 39.027, Education Code (page 3, lines 8 and 9), strike "as
defined by the commissioner by rule".
      (5)  In SECTION 2 of the bill, in amended Subsection (e),
Section 39.027, Education Code (page 3, line 18), strike "or
Section 39.023(l)".
      (6)  In SECTION 2 of the bill, immediately following amended
Subsection (e), Section 39.027, Education Code (page 3, following
line 26), insert the following:
      (g)  For purposes of this section, "recent unschooled
immigrant" means an immigrant who initially enrolled in a school in
the United States not more than 12 months before the date of the
administration of an assessment instrument under Section 39.023(a)
or (l) and who, as a result of inadequate schooling outside of the
United States, lacks the necessary foundation in the essential
knowledge and skills of the curriculum prescribed under Section
28.002 as determined by the language proficiency assessment
committee established under Section 29.063.  For purposes of this
subsection and to the extent authorized by federal law, a child's
prior enrollment in a school in the United States shall be
determined on the basis of documents and records required under
Section 25.002(a).
