Amend the proposed CSSB 702 as follows:
      In SECTION 11 of the bill (proposed committee substitute,
page 7, line 35) sec. 42.152(c), insert the following after
"Chapter 29."
Not withstanding any other provisions of this section:
      (1)  To ensure that a sufficient amount of the funds allotted
under this section are available to supplement instructional
programs and services, no more than twenty percent of the funds
allotted under this section may be used to fund disciplinary
alternative education programs established under Section 37.008,
Subchapter A of this Code, ("Alternative Settings for Behavior
Management").
      (2)  No more than half of any disciplinary alternative
education program campus' total budget may be funded from this
section's allotment.
      (3)  The commissioner may waive the limitations of
subsections (1) and (2) upon an annual petition, by a district's
board and a district's site-based decision making committee,
presenting the reason for the need to spend supplemental
compensatory education funds on disciplinary programs under Section
37.008 in excess of the limits established in subsection (a) and
(b).  The district shall in its petition report the number of
students in each grade level, by demographic subgroup, not making
satisfactory progress under the state's assessment system.  The
commissioner will make this waiver request information available
annually to the public on the agency's website.
