Amend CSSB 940 (Senate committee printing) as follows:
      (1)  On page 2, line 65, in proposed Section 51.826,
Education Code, between "PROGRAM." and "To", insert "(a)".
      (2)  On page 3, strike lines 2 and 3 (proposed Section
51.826(2), Education Code) and substitute the following:
            (2)  be a Texas resident for purposes of tuition under
Subchapter B, Chapter 54;
      (3)  On page 3, between lines 17 and 18, at the end of
proposed Section 51.826, Education Code, insert the following:
      (b)  For purposes of Subsection (a)(2), a student is not a
Texas resident as described by that subdivision solely because the
student is eligible to pay tuition at the resident tuition rate.
