HBA- MPM H.B. 23 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 23 By: Corte Public Education 3/11/2001 Introduced BACKGROUND AND PURPOSE Public school employees who are assaulted in the workplace are allowed a consecutive two-year recovery time period. However, an assaulted employee may suffer recurring injuries that are not directly related to the first injury after the two year time period has lapsed. Current law does not allow the employee to take additional time to recover from the recurring injury. House Bill 23 entitles a public school employee one year of leave time to recover from an assault and an additional second year of leave time that may be used any time within five years of the initial injury. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 23 amends the Education Code to decrease the amount of leave time from two years to one year that a school district employee is entitled to take as a result of recovery from a physical assault which took place during the employee's regular duties. The bill also authorizes an employee, before the fifth anniversary of the assault date, to receive additional leave totaling no more than one year if two physicians certify that additional recovery time is medically necessary due to a complication or other injury that resulted from the assault. EFFECTIVE DATE On passage. This Act applies beginning with the 2001-2002 school year.
