SRC-JEC H.B. 31 77(R) BILL ANALYSIS Senate Research Center H.B. 31 By: McClendon (Madla) Criminal Justice 5/11/2001 Engrossed DIGEST AND PURPOSE In 1999, 91,992 vehicles were reported stolen in Texas. There is currently a 200 hour court-ordered community service maximum for a Class A misdemeanor, which can include car theft. H.B. 31 authorizes a judge to order up to 600 hours and not less than 160 hours of community service for a car theft that is a Class A misdemeanor. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 16(b), Article 42.12, Code of Criminal Procedure, to prohibit the amount of community service work ordered by the judge from exceeding 600 hours or being less than 160 hours for an offense under Section 30.04, Penal Code, classified as a Class A misdemeanor. Makes nonsubstantive changes. SECTION 2. Makes application of this Act prospective. SECTION 3. Effective date: September 1, 2001.
