SRC-MWN H.B. 66 77(R) BILL ANALYSIS Senate Research Center H.B. 66 77R780 JAT-FBy: Pitts (J.E, "Buster" Brown) Natural Resources 5/10/2001 Engrossed DIGEST AND PURPOSE Currently, there are administrative conflicts between the licensing and complaint resolution processes in the Texas Department of Licensing and Regulation's enabling statute in the Occupations Code, the Administrative Procedure Act, and sections of the Water Code. H.B. 66 aims to reduce redundant and duplicative language from certain sections of the Water Code that pertain to water drillers. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends the heading to Section 32.002, Water Code, to read as follows: Sec. 32.002. LICENSE REQUIREMENTS. SECTION 2. Amends Section 32.002(e), Water Code, to provide that a license issued under this chapter expires annually, rather than August 31 of each year. Deletes text regarding an annual fee and text requiring the department to provide annual notification of a pending license expiration. SECTION 3. Amends Section 32.006(i), Water Code, to authorize a member of the council to receive certain compensation for travel expenses and delete text providing for a per diem payment to members. SECTION 4. Amends Section 32.011, Water Code, to delete text regarding penalties. SECTION 5. Repealer: Section 32.002(j), Water Code. Repealer: Sections 32.010(c) and (d), Water Code. Repealer: Section 32.012, Water Code. Repealer: Section 32.013, Water Code. SECTION 6. (a) Effective date: September 1, 2001. (b) Makes application of this Act prospective.
