HBA-CMT H.B. 68 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 68 By: Pitts Licensing & Administrative Procedures 3/11/2001 Introduced BACKGROUND AND PURPOSE The Texas Department of Licensing and Regulation (TDLR) is charged with the regulation of the personnel service and career counselor professions. Currently, there are multiple regulations that must be administratively followed in the process of filing complaints against persons in these professions. House Bill 68 eliminates duplicative language and modifies the requirements needed to file a complaint to allow for a more streamlined process that TDLR can use to regulate the personnel service and career counselor industry. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 68 amends law to provide that a complaint filed against a personnel service or a career counselor with the commissioner of licensing and regulation is no longer required to be done by sworn affidavit. EFFECTIVE DATE September 1, 2001.
