DIGEST AND PURPOSE 

Under current federal law, a man between the ages of 18 and 26 must
register with the United States Selective Service System (system).  A man
who is not registered with the system in accordance with federal law is
ineligible to receive federal funds and state student loans and may not be
hired as a state employee.  H.B. 116 requires the Department of Public
Safety to electronically send information, including the applicant's social
security number, from an application for a driver's license to the system
for the purpose of registering an applicant under the Military Selective
Service Act. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a
state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 521.044(a), Transportation Code, to authorize
information provided on a driver's license application that relates to the
applicant's social security number to be used only by the Department of
Public Safety (department) or disclosed only to the United State Selective
Service System (system) as provided by Section 521.147. 

SECTION 2.  Amends Chapter 521G, Transportation Code, by adding Section
521.147, as follows: 

Sec. 521.147.  REGISTRATION WITH SELECTIVE SERVICE SYSTEM.  Requires the
department to send in an electronic format to the system the information
from the application necessary to register the applicant under the Military
Selective Service Act (50 U.S.C. App. Section 451 et seq.), as amended,
including the applicant's social security number, after an application for
an original, renewal, or duplicate driver's license is submitted by a male
applicant who on the date of the application is at least 18 years of age
but younger than 26 years of age.  Requires the department, before
accepting an application from an applicant to which this section applies,
to notify the applicant that the application for a driver's license also
constitutes registration with the Selective Service System for persons who
are subject to registration and who have not previously registered.
Provides that the applicant's submission of application following this
notification constitutes the applicant's consent to the sending of the
information, including the applicant's social security number, and to the
registration.  Authorizes the department, in addition to the notification
required by this section, to conspicuously post at each location where
applications for driver's licenses are accepted one or more signs, in
English and Spanish, providing the information contained in the
notification. 

SECTION 3.  Effective date: September 1, 2001.  
            Makes application of this Act prospective.
