DIGEST AND PURPOSE 

Under current federal law, a man between the ages of 18 and 26 must
register with the United States Selective Service System (system).  A man
who is not registered with the system in accordance with federal law is
ineligible to receive federal funds and state student loans and may not be
hired as a state employee.  C.S.H.B. 116 requires the Department of Public
Safety to develop a selective service consent statement as part of an
application for a driver's license. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a
state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 521.044(a), Transportation Code, to authorize
information provided on a driver's license application that relates to the
applicant's social security number to be used only by the Department of
Public Safety (department) or disclosed only to the United State Selective
Service System (system) as provided by Section 521.147. 

SECTION 2.  Amends Chapter 521G, Transportation Code, by adding Section
521.147, as follows: 

Sec. 521.147.  OPTIONAL REGISTRATION WITH SELECTIVE SERVICE SYSTEM.
Requires the department to develop by rule a selective service consent
statement as a part of the application for an original, renewal, or
duplicate driver's license or personal identification certificate.
Requires the consent statement to include a place to indicate consent or
declination to register with the system and state the benefits and
penalties associated with consent or declination to register.  Requires the
department to present the statement to each application who is subject to
registration with the Selective Service System and record the applicant's
response.  Provides that a response is required to complete the application
for a license or certificate for such an applicant.  Requires the
department to forward to the system, in an electronic format, only the
information necessary for registration of an applicant consenting to
registration.  Authorizes the department, in addition to the statement
required by this section, to conspicuously post at each location where
applications for driver's licenses are accepted one or more signs, in
English and Spanish, providing the information contained in the statement. 

SECTION 3.  Effective date: September 1, 2001.  
            Makes application of this Act prospective.
