SRC-MWN H.B. 120 77(R) BILL ANALYSIS Senate Research Center H.B. 120 77R463 JSA-DBy: West, George "Buddy" (Duncan) Jurisprudence 4/10/2001 Engrossed DIGEST AND PURPOSE The student body of The University of Texas of the Permian Basin has approved the measure to authorize the board of regents of The University of Texas System to levy a mandatory intercollegiate athletics fee not to exceed $5 per semester credit hour. As proposed, H.B. 120 authorizes the board of regents of The University of Texas System to impose the fee. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 54E, Education Code, by adding Section 54.5331, as follows: Sec. 54.5331. INTERCOLLEGIATE ATHLETIC FEE; THE UNIVERSITY OF TEXAS OF THE PERMIAN BASIN. (a) Authorizes the board of regents of The University of Texas System to impose a mandatory intercollegiate athletics fee at The University of Texas of the Permian Basin if the fee is approved by a majority vote of the students participating in a general student election held for that purpose. Prohibits the amount of the fee from exceeding $5 per semester credit hour for each regular semester in the first academic year in which the fee is imposed. (b) Authorizes the amount of the fee per semester credit hour to be increased from one academic year to the next only if the increase is approved by a majority vote of the students of the university participating in a general student election held for that purpose. (c) Authorizes the board of regents to prorate the amount of the fee for a summer session. (d) Provides that the fee imposed under this section is in addition to any other fee authorized by law and is prohibited from being considered in determining the maximum student services fees that are authorized to be imposed under Section 54.503. (e) Authorizes the board of regents, if a certain condition is met, to impose the fee without calling an additional election under Subsection (a). Provides that this subsection expires January 1, 2003. SECTION 2. Effective date: Effective date: upon passage or September 1, 2001.
