SRC-CTC H.B. 154 77(R) BILL ANALYSIS Senate Research Center H.B. 154 77R10741 KLA-FBy: Thompson (Gallegos) Health & Human Services 5/10/2001 Engrossed DIGEST AND PURPOSE Under current law the Health and Human Services Commission provides a minimum personal needs allowance of $30 a month to Medicaid residents in long-term care facilities. This allowance enables residents to purchase simple goods and services which can help maintain feelings of control over their lives. H.B. 154 increases the minimum personal needs allowance to $60 a month. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 32.024(v), Human Resources Code, as added by Chapter 1333, Acts of the 76th Legislature, Regular Session, 1999, to require the Health and Human Services Commission (HHS) to set a personal needs allowance of not less than $60 a month for a resident of certain facilities. Deletes existing text relating to an increase of the personal needs allowance above the $30 minimum and to the availability of funds. SECTION 2. Effective date: September 1, 2001. Makes application of this Act prospective.
