HBA-SEP C.S.H.B. 218 77(R)BILL ANALYSIS Office of House Bill AnalysisC.S.H.B. 218 By: Wise Economic Development 4/26/2001 Committee Report (Substituted) BACKGROUND AND PURPOSE Under current law, local workforce development boards (board) are composed of various representatives of the overall workforce of this state, including the private sector, organized labor and community based organizations, education agencies, vocational rehabilitation agencies, public assistance agencies, economic agencies, and the public employment sector. However, there are no representatives of the Armed Forces of the United States included on a board. C.S.H.B. 218 provides that at least one of the members of a board must be a veteran. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS C.S.H.B. 218 amends the Government Code to provide that at least one of the members of a local workforce development board must be a veteran who meets the qualifications required for board membership. The bill also provides for the implementation of the change in membership requirements. EFFECTIVE DATE September 1, 2001. COMPARISON OF ORIGINAL TO SUBSTITUTE C.S.H.B. 218 modifies the original to provide that at least one of the members of a local workforce development board (board) must be a veteran who meets the qualifications for board membership rather than adding representatives of veterans of the Armed Forces of the United States to the private sector representatives who compose a board. The substitute also provides that if the bill conflicts with federal law or would invalidate a waiver granted under federal law, the bill is of no effect.
