SRC-JEC H.B. 298 77(R) BILL ANALYSIS Senate Research Center H.B. 298 77R2139 AEI-FBy: West, George "Buddy" (Duncan) Intergovernmental Relations 5/7/2001 Engrossed DIGEST AND PURPOSE Under current law, the assistant administrator of the Ector County Hospital District (district) is appointed by and serves at the will of the board of directors of the district. H.B. 298 provides that any assistant administrators are appointed by and serve at the will of the administrator of the district. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Sections 4.13(a), (b), and (c), Chapter 550, Acts of the 71st Legislature, Regular Session, 1989, as follows: (a) Provides that the administrator of the Ector County Hospital District (district) and the attorney for the district serve at the will of the board of directors of the district. Deletes the authority for the board to appoint a qualified person as assistant administrator for the district. (b) Authorizes the administrator to appoint one or more qualified persons as assistant administrators for the district. Provides that an assistant administrator serves at the will of the administrator. Deletes references to the attorney serving at the will of the board. (c) Entitles the administrator, attorney, and each assistant administrator to compensation as determined by the board. SECTION 2. Effective date: upon passage or September 1, 2001.
