HBA-MPM H.B. 353 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 353 By: Allen Public Safety 3/13/2001 Introduced BACKGROUND AND PURPOSE Currently, the Texas Department of Public Safety (DPS) charges fees for processing criminal history information requests from persons who are not affiliated with a criminal justice agency. Consequently, other governmental agencies and nonprofit organizations are required to pay this fee. House Bill 353 exempts a political subdivision of this state, a state or federal agency, or a nonprofit corporation from paying a fee to DPS for processing these inquiries. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 353 amends the Government Code to exempt a political subdivision of this state, a state or federal agency, or a nonprofit corporation from being charged a fee by the Department of Public Safety for processing inquiries for criminal history record information. EFFECTIVE DATE September 1, 2001.
