SRC-BWC H.B. 360 77(R) BILL ANALYSIS Senate Research Center H.B. 360 77R1924 KSD-DBy: Wise (Zaffirini) Jurisprudence 3/29/2001 Engrossed DIGEST AND PURPOSE Some children are sexually victimized by engaging in prostitution, pornography, and live sexual performances. Sexually abused children are likely to suffer emotionally as a result of their victimization. Under current law, "abuse" includes a person compelling, encouraging, or permitting child pornography or the sexual conduct of a child. As proposed, H.B. 360 expands the definition of "abuse" to include sexual performance by a child. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 261.001(1), Family Code, to redefine "abuse" to include a person causing, permitting, encouraging, engaging in, or allowing a sexual performance by a child as defined by Section 43.25 (Sexual Performance by a Child), Penal Code. SECTION 2. Effective date: upon passage or September 1, 2001.
