SRC-MWN H.B. 372 77(R) BILL ANALYSIS Senate Research Center H.B. 372 77R3086 MI-FBy: Gallego (Madla) Natural Resources 4/11/2001 Engrossed DIGEST AND PURPOSE Under current law, voting eligibility in the Maverick County Water Control and Improvement District No. 1 is based on certain criteria for persons to vote in the district elections. As proposed, H.B. 372 amends the Water Code concerning the eligibility to vote in the Maverick County Water Control and Improvement District No. 1. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 51E, Water Code, by adding Section 51.221, as follows: Sec. 51.221. ELIGIBILITY TO VOTE: MAVERICK COUNTY WATER CONTROL AND IMPROVEMENT DISTRICT NO. 1. (a) Defines "district." (b) Sets forth provisions regarding voting eligibility. (c) Requires a person eligible to vote under Subsection (b) to register with the district not later than the 30th days before the date of a district election in order to vote in that district election. Requires the district to file with the county clerk of Maverick County a certified copy of the list of the district's registered voters not later than the 25th day before the date of each district election. SECTION 2. Provides that a person who on January 1, 2002 ,is not eligible under Section 51.221(b), Water Code, as added by this Act., to vote in an election held by the Maverick County Water Control and Improvement District No. 1 is not liable for any tax imposed by the district on or after that date. The person continues to be liable for the payment of any tax imposed before that date and for the person's pro rata share of any district debt existing on that date. SECTION 3. Effective date: September 1, 2001.
