DIGEST AND PURPOSE 

Current statutes refer to incapacitated persons in antiquated language.  As
proposed, H.B. 483 updates the language. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a
state officer, institution, or agency.  

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 117.052(c), Local Government Code, to update
antiquated language by characterizing persons as "incapacitated," rather
than "lunatics," "idiots," and "determined to be non compos mentis." 

SECTION 2.  Amends Section 117.112, Local Government Code, to make
conforming changes. 

SECTION 3.  Amends Section 93, Texas Probate Code, to make conforming
changes. 

SECTION 4.  Effective date: upon passage or September 1, 2001.
