HBA-MSH H.B. 483 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 483 By: Naishtat Human Services 2/11/2001 Introduced BACKGROUND AND PURPOSE In previous sessions, the terms "lunatics," "idiots," and, "non compos mentis," as well as some references to "minors," were removed from the statutes and replaced by the term "incapacitated." These terms in three sections of the Local Government and Probate codes were not changed in previous sessions. House Bill 483 updates statutory references in the three sections. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 483 amends the Local Government and Probate codes to remove the terms "lunatics," "idiots," "non compos mentis," and "minors" and replace them with the term "incapacitated," as applicable. EFFECTIVE DATE On passage, or if the Act does not receive the necessary vote, the Act takes effect September 1, 2001.
