SRC-JEC H.B. 593 77(R) BILL ANALYSIS Senate Research Center H.B. 593 77R1236 KSD-FBy: Goodman (Harris) Jurisprudence 4/24/2001 Engrossed DIGEST AND PURPOSE Current law requires certain identifying information to be included in an application for a protective order regarding family violence, the registration for enforcement of a support order, and a petition for a suit affecting the parent-child relationship. As a result, there are concerns that some of the information required, particularly the address, could provide a method for a perpetrator of family violence to locate the perpetrator's victim. H.B. 593 removes the requirement that certain information be included in certain applications and petitions in order to protect the location of a person until the court determines that the person's location should be revealed. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 82.004, Family Code, to remove the requirement that an application for a protective order state the address of an individual alleged to have committed family violence. SECTION 2. Amends Section 102.008(b), Family Code, to remove the requirement that the petition in a suit affecting the parent-child relationship include: the sex, place of birth, and place of residence of a child; the age and place of residence of the petitioner; the ages and place of residence of the parents; the place of residence of the managing conservator or the child's custodian; the places of residence of the guardians of the person and estate of the child; the places of residence of possessory conservators or other persons having possession of or access to the child; and the place of residence of an alleged father of the child. SECTION 3. Amends Section 159.602(a), Family Code, to remove the requirement that the obligor's address and the address of the obligee be stated in information sent to a tribunal in this state to register a support order or income-withholding order of another state. SECTION 4. Effective date: September 1, 2001. Makes application of this Act prospective.
