BACKGROUND AND PURPOSE 

Current law requires a pharmacy to notify consumers of the telephone number
and mailing address of the Texas State Board of Pharmacy (state board).
House Bill 667 applies the same concept to an Internet pharmacy by
requiring the pharmacy's website to link to the state board's website. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

ANALYSIS

House Bill 667 amends the Occupations Code to require a pharmacy that
maintains a generally accessible Internet site to link its site to the
Internet site maintained by the Texas State Board of Pharmacy.  The bill
provides that the link must be on the pharmacy's initial home page, and, if
the pharmacy sells drugs through its site, on the page where the sale
occurs. 

EFFECTIVE DATE

November 1, 2001.
