BACKGROUND AND PURPOSE 

Currently, there is no provision allowing Texas to participate in a
multistate lottery game marketed by a consortium of states.  The combined
population of the states provide a larger pool of players, resulting in
potentially  larger jackpots.  Each state pays only its proportionate share
of the jackpots, based on sales, and the revenue generated within each
state is retained by that state.  House Bill 891 would authorize the Texas
Lottery Commissioner to enter into written agreements with one or more
states to participate in the operation of a multistate lottery game.   

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

ANALYSIS

House Bill 891 amends the Government Code to authorize the Texas Lottery
Commission to enter into a written agreement with the appropriate officials
of one or more states to participate in the operation of a multistate
lottery game.  The bill sets forth provisions for participation in a
multistate lottery game and use of received revenues.   

EFFECTIVE DATE

On passage, or if the Act does not receive the necessary vote, the Act
takes effect September 1, 2001.
