DIGEST AND PURPOSE 

H.B. 906 sets forth certain provisions regarding the continuation and
functions of the Coastal Coordination Council and continues the Coastal
Coordination Council until the year 2013.  

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a
state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 33.052(c), Natural Resources Code, to delete text
regarding persons who live in the Texas coastal area. 

SECTION 2. Amends Section 33.203(20), Natural Resources Code, to redefine
"council." 

SECTION 3. Amends Section 33.204, Natural Resources Code, by amending
Subsection (b) and adding Subsection (g), as follows: 

(b) Requires the Coastal Coordination Council (council) to set aside time
at each meeting for public comment on any issue under the jurisdiction of
the council. 

(g) Authorizes the council to award grants to projects that further the
goals and policies of the council. Requires the council to establish the
procedures for making any determination related to awarding a grant. 

SECTION 4. Amends Chapter 33F, Natural Resources Code, by adding Sections
33.2041, 33.2042, 33.2043, 33.2044, and 33.2045, as follows: 

Sec. 33.2041. COMPOSITION OF THE COUNCIL; TERMS. Sets forth provisions
regarding the composition of the council and terms of the positions. 

Sec. 33.2042. ELIGIBILITY OF COUNCIL MEMBERS. (a) Defines "Texas trade
association." 

(b) Provides that certain persons are prohibited from being a public member
of the council. 

(c) Provides that certain persons are prohibited from serving on the
council or act as the general counsel to the council. 

Sec. 33.2043. GROUNDS FOR REMOVAL. Sets forth provisions regarding grounds
for removal from the council. 

 Sec. 33.2044. STANDARDS OF CONDUCT. Sets forth provisions regarding the
standards of conduct among council members. 

Sec. 33.2045. TRAINING. Sets forth provisions regarding the requirement of
a certain training program in order to perform certain duties as a member
of the council. 

SECTION 5. Amends Section 33.205(c), Natural Resources Code, to prohibit
the council from reviewing a proposed action unless certain conditions
exist. 

SECTION 6. Amends Section 33.207, Natural Resources Code, to require the
council to report to the legislature certain information. 

SECTION 7. Amends Section 33.211, Natural Resources Code, to provide that
the council is abolished and this subchapter expires September 1, 2013,
rather than 2001. 

SECTION 8. Amends Chapter 33F, Natural Resources Code, by adding Section
33.212, as follows: 

Sec. 33.212. COMPLAINTS. Sets forth provisions regarding the procedures for
filing complaints to the council. 

SECTION 9. Makes application of this Act prospective.

SECTION 10. Effective date: September 1, 2001.
