BACKGROUND AND PURPOSE 

Under current law, an order of protective custody is necessary to transfer
a person who has been admitted under emergency detention from a county
mental health facility to an appropriate mental health facility. House Bill
922 sets forth the requirements under which a person who has been admitted
to a county mental health facility may be detained in custody or
transferred to an appropriate mental health facility. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

ANALYSIS

House Bill 922 amends the Health and Safety Code to authorize a person
admitted to a county mental health facility to be detained in custody and
transported to another mental health facility under certain circumstances.
The person may be detained if an application for emergency detention or a
motion for an order of protective custody is filed, and a physician
conducts a preliminary examination of the person.  H.B. 922 provides that a
person may be detained for not longer than 24 hours unless a written order
for further detention is obtained. 

EFFECTIVE DATE

On passage, or if the Act does not receive the necessary vote, the Act
takes effect September 1, 2001.
