SRC-TBR, MKV H.B. 936 77(R)BILL ANALYSIS Senate Research CenterH.B. 936 By: Solis, Jim (Van de Putte) Business & Commerce 5/10/2001 Committee Report (Amended) DIGEST AND PURPOSE Local workforce development boards (boards) were not specifically designated as either governmental entities or political subdivisions when the boards were created under the Workforce and Economic Competitiveness Act. Consequently, it is not always clear under current law whether the boards are subject to specific statutes applicable to governmental entities and political subdivisions. H.B. 936 makes the boards subject to certain laws applicable to governmental entities and political subdivisions RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 551.001(3), Government Code, to redefine "governmental body." SECTION 2. Amends Section 552.003(1), Government Code, to redefine "governmental body." SECTION 3. Amends Section 771.002(1), Government Code, to redefine "agency." SECTION 4. Amends Section 271.081, Local Government Code, to redefine "local government." SECTION 5. Amends Section 2175.001(1), Government Code, to redefine "assistance organization." SECTION 6. Amends Section 2308.257, Government Code, as follows: (a) Requires a member of a local workforce development board (board) to avoid the appearance of conflict of interest by not voting in, or participating in, any decision by the board regarding the provision of services by such member, or any organization which that member directly represents, or on any matter which would provide direct financial benefit to that member, the member's immediate family, or any organization which that member directly represents. (b) Requires Subsection (a) to serve as a minimum standard and to not be construed as to limit the board's authority for more restrictive governance to prevent real and/or apparent conflict of interest. SECTION 7. Effective date: September 1, 2001.
