SRC-JBJ H.B. 940 77(R) BILL ANALYSIS Senate Research Center H.B. 940 77R3902 GJH-DBy: Haggerty (West, Royce) Criminal Justice 5/6/2001 Engrossed DIGEST AND PURPOSE Instances have occurred in which an individual posing as a security officer has unscrupulously gained access to a business or approached individuals with the intent of committing a crime against the individual or business. H.B. 940 makes the impersonation of a security officer a Class A misdemeanor. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 1702P, Occupations Code, by adding Section 1702.3875, as follows: Sec. 1702.3875. IMPERSONATING SECURITY OFFICER; OFFENSE. Provides that a person commits an offense if the person impersonates a commissioned or noncommissioned security officer with the intent to induce another to submit to the person's pretended authority or to rely on the person's pretended acts of a security officer or knowingly purports to exercise any function that requires registration as a noncommissioned security officer or a security officer commission. Provides that an offense under this section is a Class A misdemeanor. SECTION 2. Effective date: September 1, 2001.
