HBA-CMT, EDN H.B. 940 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 940 By: Haggerty Public Safety 2/27/2001 Introduced BACKGROUND AND PURPOSE Instances have occurred in which individuals posing as a security officer have gained access to businesses or approached individuals with the intent of robbing the business or committing a crime against the individual. In order to work as a security officer in Texas, individuals must be licensed, pass the criminal background check, meet the training requirements, and maintain liability insurance. House Bill 940 makes the impersonation of a security officer a Class A misdemeanor. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 940 amends the Occupations Code to provide that a person commits a Class A misdemeanor if the person impersonates a commissioned or noncommissioned security officer with the intent to induce another to submit to the person's pretended authority or to rely on the person's pretended acts of a security officer, or if the person knowingly purports to exercise any function that requires registration as a noncommissioned security officer or a security officer commission. EFFECTIVE DATE September 1, 2001.
