SRC-JEC H.B. 1041 77(R) BILL ANALYSIS Senate Research Center H.B. 1041 By: Smith (Harris) Intergovernmental Relations 4/19/2001 Engrossed DIGEST AND PURPOSE Currently, only one Tarrant County court has the authority to hear appeals of Class C misdemeanors from municipal and justice courts. There is a significant backlog on such appeal cases. As proposed, H.B. 1041 gives the County Criminal Court No. 10 of Tarrant County the jurisdiction to hear Class C misdemeanor appeal cases to help reduce the backlog. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 25.2223(a), Government Code, to provide that the County Criminal Courts Nos. 5 and 10 of Tarrant County have concurrent jurisdiction within the county of all appeals from criminal convictions under the laws of this state and the municipal ordinances of the municipalities located in Tarrant County that are appealed from the justice courts and municipal courts in the county. SECTION 2. Effective date: upon passage or September 1, 2001.
