DIGEST AND PURPOSE 

The Texas Constitution authorizes the creation of groundwater conservation
districts to plan, develop, and regulate the use of water. As proposed,
H.B. 1136 creates the Post Oak Groundwater Conservation District in
Colorado County, subject to approval at a confirmation election. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a
state officer, institution, or agency.

SECTION 1. CREATION. Sets forth provisions regarding the creation of the
Post Oak Groundwater Conservation District (district). 

SECTION 2. DEFINITION. Defines "district."

SECTION 3. BOUNDARIES. Sets forth provisions regarding the boundaries of
the district. 

SECTION 4. FINDING OF BENEFIT. Sets forth provisions regarding the benefits
of the district. 

SECTION 5. GENERAL POWERS. Sets forth provisions regarding the powers and
duties of the district. 

SECTION 6. REGIONAL COOPERATION. Sets forth duties of the district
regarding regional cooperation. 

SECTION 7. BOARD OF DIRECTORS. Sets forth provisions regarding the
composition of the district's board of directors. 

SECTION 8. TEMPORARY DIRECTORS. Sets forth provisions regarding the
district's temporary directors. 

SECTION 9. METHOD OF ELECTING DIRECTORS: COMMISSIONERS PRECINCTS. Sets
forth provisions regarding the election of directors. 

SECTION 10. CONFIRMATION AND INITIAL DIRECTORS' ELECTION. Sets forth
provisions regarding the election to confirm the establishment of the
district and to elect initial directors. 

SECTION 11. ELECTION OF PERMANENT DIRECTORS. Sets forth provisions
regarding the election of directors. 

SECTION 12. DISTRICT REVENUES. Sets forth provisions regarding the
district's authority to perform certain procedures to pay certain costs of
the district. 
 
SECTION 13. FINDINGS RELATED TO PROCEDURAL REQUIREMENTS. Provides that the
procedural requirements necessary for the establishment of the district
have been met. 


SECTION 14. EFFECTIVE DATE; EXPIRATION DATE. (a) September 1, 2001.

(b) Provides that if the creation of the district is not confirmed at an
election before September 1, 2003, this Act expires on that date.
