HBA-TBM H.B. 1164 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1164 By: Eiland Pensions & Investments 3/5/2001 Introduced BACKGROUND AND PURPOSE Under current law, a peace officer who has performed prior state law enforcement service does not receive credit for that service if the officer enters the employ of a county or municipal law enforcement agency that participates in the Texas County and District Retirement System (TCDRS). House Bill 1164 allows a member of TCDRS to establish credit in TCDRS for previous service as a peace officer who made contributions to the Employees Retirement System of Texas or the Texas Municipal Retirement System. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 1164 amends the Government Code to set forth provisions by which a contributing member of the Texas County and District Retirement System (TCDRS) is authorized to establish credit for current service in TCDRS for service previously performed as a licensed and commissioned peace officer that was included in the coverage of the Employees Retirement System of Texas or the Texas Municipal Retirement System. The bill sets forth the requirements for a member claiming credit for previous peace officer service. EFFECTIVE DATE September 1, 2001.
