BACKGROUND AND PURPOSE 

The 76th Legislature reorganized the statutes relating to the Department of
Protective and Regulatory Services.  However, incorrect references were
included in the revision, and one section was not included in the proper
order.  House Bill 1179 updates statutory references and redesignates a
section within the Human Resources Code.   

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

ANALYSIS

House Bill 1179 amends the Human Resources Code to redesignate Section
48.0381 as Section 48.103 and replaces the term incompetent with
incapacitated and the term community support with communitybased.   

EFFECTIVE DATE

On passage, or if the Act does not receive the necessary vote, the Act
takes effect September 1, 2001.
